50/50 liability

I was in a crash last year and my car insurance was paid out two weeks later. It's still on going with me saying the other person was liable and him saying I was. He's offered 50/50 I haven't responded yet because I don't know what that will mean with my car insurance payout. Will his insurance pay 50% and I have to pay back 50% to my insurance. Sorry if that makes no sense but I don't know how to word it.

Don't do a thing, pass it onto your insurers. But keep track of things in case they aren't taking enough action. I'm presuming you mean your comprehensive policy paid your damage? You shouldn't be paying anything either way beyond the excess. If the cost of the claim was 1000 or 10,000 it should have the same impact on you and its insurers who will get the money back. They will also decide if they accept the 50/50 settlement. In reality that can mean each pays their own damage rather than a literal 50/50 split but that depends on the level of damage done to each car. The only downside to a partial liability is you won't get your no claims bonus back, if the other party paid 100% you would. Let the insurers worry about all this though.

Sorry just to be clear, 50/50 means 50% liability each and has nothing to do with the value of the claim.

Thank you. Both cars were write off so no fixing. The 50/50 is for the personal injury claim, the accident was in may last year and I'm just so fed up with it all. I was the only one to produce a witness and it's made no difference because it's still not resolved. I'm fed up with the back and forth with them asking for the same evidence over and over. Now he's asked for 50/50 and I don't know what to do. I just want to put a line under it and move on without the anxiety of another email asking me for more evidence that I haven't got. It's so frustrating.

Oh I get you. I understood a personal injury payment was always in full and final settlement and couldn't be revoked afterwards, even partially? I used to work in this field but am gone a long time plus it was Ireland so I don't want to give you wrong advice.

It's really stressful, I understand that.
