Should DD get holiday pay for this job?

DD (16) works in a cafe one day a week for 6 hours on minimum wage of £5.28 an hour.

They are a lovely employer and she really likes it there. They let her take the day off when she needs to for a hobby she does, and she's done this twice now. They didn't give it to her as holiday and it was unpaid, which she just accepts.

Is she entitled to holiday pay when she only does one day a week. I thought she would, but she thinks not.

It all depends on how long she has worked there.
You’re entitled to accrue 5.6 weeks on holiday a year.
as she only does 1 day a week that will be 5.6 days over the year. For zero hour contracts it’s common to be paid this accrued amount randomly after it’s built up rather than on actual days

Yes, I think as an employee she should be entitled to holiday pay although it wouldn’t be much working only 6 hours a week. As a rough rule, holiday pay is calculated at approx 12.07% of earnings so for every shift she works, she should accrue approx £3.82 of holiday pay. Or it could be worked out as 1/5 of the holiday entitlement of someone who works 5 days a week (probably 28 days) so 5.6 days of paid holiday each year.

ACAS provide free employment advice but my understanding is that absolutely everyone is entitled to 5.6 weeks annual leave, they have a very useful helpline, a quick Google will throw it up.

Is she actually asking for a day holiday or just asking to miss a shift? Maybe they assume she’s saving holiday days for a later date or something?

If she has a zero hour contract she won’t get paid but she is legally able to take time off without issue.

Not true @wednesday32 everyone is entitled, link here to Gov.UK website stating this, you accrue based on what you actually work not what your contract says.
