Previous tenant still has their car registered at my address

Is this legal? DVLA cannot help. Parking and speeding fines are coming to my address, in their name. I return to sender. Any advice please?

According to the government website "You can be fined up to £1,000 if you do not tell DVLA when your address changes."

So no, it's not legal. If DVLA can't help I don't know what you can do.

Don't worry about it. The fines aren't yours, they have the correct name for the vehicle. Just RTS as you are doing if any debt collection letters come.

You can also open the letters and write to the companies stating that you don't know the person, they haven't lived at the address since X date (when you moved in), you don't own the car and never have, and tell them to not send letters to your address again. That often stops them. Don't phone them, write, and don't give them your name.

If debt collectors come to the door, don't answer or if you do, don't let them in. They're not entitled to come in or to have any details from you.

Bailiffs can come in (with a court order I think) and take stuff belonging to the person with the debt but since that person doesn't live there and is nothing to do with you or has any stuff there, it's not a problem.

If you decide to fetch someone some information eg proof of who you are or your tenancy agreement, shut the door in their face first, don't leave it open because they'll come in.

I've been waiting for my new log book since Jan - apparently the dvla have a massive backlog so it's taking ages!

If parking and speeding fines are coming through regularly and often, they haven't registered the car at a new address and awaiting new log book. They're aware the car is incorrectly registered, doing whatever the hell they like and expecting it all to never catch up with them.

It's registered and maybe insured in somebodys name, companies will start digging around for more information when they want to take the driver (or registered keeper, if they doesn't provide the name of who was driving at the time of the offense) to court for non-payment of fines.

If you get court summons OP you'll need to check your credit score with those organisations who do it. It's possible your credit score will be affected by someone having CCJ's at your address, so you'd need to get that person removed as they're nothing to do with you and not registered as living at the address at the time of the CCJ's.

There'll definitely be CCJ's if there's a court summons (I don't know if it'll make a difference for you to write to the court about the person not living there) because if there's a court case and they don't show up, which they definitely won't since they won't have received the sumons if it came to your address, then the company will win by default.

I don't know what the procedure is for obtaining a new log book these days if you've lost it. As you've the name these fines are addressed to, you might be able to find out via the electoral register where they live. I've no idea whether you could apply for a new log book pretending to be them and giving their details. I don't expect that's legal, but neither is what they're doing!

It is likely that the DVLA are being their usual slow self, we’ve taken our vehicle out of the UK, all of the required forms were completed in August. These are yet to be processed so as far as the DVLA are concerned the vehicle still ‘resides’ at our old address in the UK.

Her credit score won't be affected by someone else's CCJs even if at the same address

Did you do it online? I changed the address on my two vehicles a couple of weeks ago and had them.back within a week. I have to say I was amazed.

Contact the letting agent. They should have a forwarding address for previous tenant.
