Can still drive until charged. (non of my business)

My NDN son was involved in a car crash just before Christmas.
No other car was involved thank goodness as he was driving
after smoking weed.
He was arrested but not charged until his blood test results come back.
This can take upto 5 months.
Yet he his still allowed to drive. Surely the law doesn't allow this.
Of course I don't know about his insurance etc. He is 20.

Happened here, a guy high on drugs killed a middle aged woman. Turned out he had been stopped and tested for drug driving five months previously. Wasn’t banned at that time, but then received a ban and conviction for the earlier drug driving incident at the trial for the killing. If he’d been processed more quickly after the first incident, he would have been banned and not gone on to kill the lady.
