Would anyone in the know advise to request that the below is reviewed by the Ombudsman or just drop it? It's £250 but I feel so deflated and it's been going on for so long :(
eBay have not sent me any information following my SAR nor honoured a refund that a chat agent said would happen and I have in writing.

"Miss R is unhappy that eBay Commerce UK Ltd, despite promising to do so, hasn’t refunded the cost of a faulty iPhone which she purchased on 4 January 2023 with a 12-month warranty on eBay marketplace. eBay didn’t uphold the complaint.
I’ve considered the information provided by both parties. eBay has told us that our service can’t look at this complaint, because it relates to activities carried out by eBay – the online marketplace, rather than eBay Commerce UK Ltd which is regulated by the FCA as a separate company that deals with payment services.
 This service can’t look at all the complaints referred to us. The rules say we can only consider complaints about businesses which are authorised by the Financial Conduct Authority (FCA) to carry out certain activities, which include regulated activities and payment services. These rules are contained in the FCA Handbook (available online) and are known as DISP. The relevant section here is DISP 2.3.1R. These rules say we can consider complaints about certain eBay companies, where they are regulated, for example, eBay Commerce UK Limited which is regulated to provide payment services and other activities. It’s worth noting that these services and activities are aimed towards sellers on eBay rather than buyers, like Miss R.
 Miss R’s complaint is about eBay’s decision not to refund her for the iPhone she purchased on its marketplace and an associated Subject Access Request (SAR). Initially Miss R complained to eBay under its Money Back Guarantee.
 eBay as an online marketplace and auction site for buyers and sellers to sell and purchase goods, isn’t a regulated business, so our rules mean that we can’t consider complaints about it. The guarantee is also offered by eBay i.e. the marketplace. Again, this type of activity and business isn’t something we can consider under the rules. Nor is the decision made under this guarantee something that eBay Commerce UK Ltd is responsible for. So we can’t consider any aspect of this complaint.
This is the opinion of Investigator. Unless either party wants to take things further, there’s no need to do anything and this case will close on 26 February 2024. If either party disagrees and wants an Ombudsman to consider the case, they must inform us and submit any further evidence or representations by 26 February 2024. Requests for more time must also be made by that date. More details on how the Financial Ombudsman Service makes decisions can be found here. It may take a few months for a case to reach an Ombudsman.
