Shall I just resign now, go through 6 weeks of pip or try for a settlement agreement?

  1. Underperformed at work
  2. Due to autism and personal issues
  3. Been there less than 2 years, only 6 months in fact
  4. If I do get dismissed at the end of my PIP, would my ex employer tell the next one...how would next employer find out
  5. The current company only does references like 'x worked there from X to y'
  6. Shall I ask for redeployment to another service line?

Redeployment can be a reasonable adjustment and I've seen people succeed after it.

They have no reason that I can see to enter into a settlement agreement with someone who only has 6 months service.

I don't think they will offer a settlement if you've only been there 6 months. Unless they are actively discriminating against you.

A PIP is designed to help you improve. I’ve been a manager and helped various staff through a number of PIPs and it’s not always with a dismissal design.

Why not have an honest conversation and see what they expect of you?

My manager seemed very angry at me.... He said my autism may stop me from doing well at the job
Also I performed appallingly

I appreciate autism means nuance can sometimes be lost but was he really that direct and rude about it without offering any level of support or comment? If he was and you don't feel like you've been adequately trained it may be worth speaking with ACAS and/or another manager in the department.

Were the mistakes you made dangerous - either reputationally, financially or physically?

Can you give us any context.
My manager was quite poor with me.
I explained some of my traits were potentially ADHD and not personal.
Over the year she must've seen I have many strengths too.

So what are they going to do to help you? You have to help yourself here because if you present at work how you are doing so on this thread I can see why they're reluctant to help.

Can you see what your weaknesses are? Can you see where you need help to perform?

If so, I can't remember if you didn't yet have an autism diagnosis, or if you'd only just told the company about it? You were underperforming, had failed all 5 necessary exams and weren't completing your timesheets?

Training contract? What's it say about exam failure?

If in your first 6 months you've failed multiple exams and you're not completing work within budget, I'd expect them to dismiss in line with your training contract.

Is there a suitable role that's vacant that you could be redeployed into?

Did you have reasonable adjustments for the exams and in the workplace?

What protection?

Disabled people can be dismissed. Not all adjustments are reasonable. They can't change the nature of professional services for the op.

Anyone would be dismissed for failing all of their exams though... it's usually written into the contract

Disabled people can be dismissed. Not all adjustments are reasonable. They can't change the nature of professional services for the op.

That is true... I think I'm better off leaving as my teams pissed with my underperformance
I think I will retrain into a data analyst or ops analyst or business analyst

Also the reason for my underperformance was situational too... I'm currently facing a dui charge brought on by taking cannabis and I was told by my lawyer that I will not be allowed to practise as a lawyer after I qualify if I am convicted. I am sure I will be convicted.

So I am better off going into an unregulated industry i.e. not law, finance, accountancy, education,.care homes etc.

I asked my boss if he could redeploy me and he said no.
So likely gonna be put on PIP
Or resign

No he does not
I think I can do the job, I've just been stressing about the dui problem and eventually the dui will catch up with me so even I do survive the PIP eventually I have to quit ....
This law is no longer my sector
What other sectors do I do into?
