Who gets to inherit the house and cash?

A man has died and has been divorced for 5 years.

He has 2 children with his ex wife who are 7 and 9.

He has a toddler with someone he's never been married to or lived with. Does the little boy get anything at all?

No will in place, for clarification.

Just wondered as this is now in the past but the toddler never for anything, it all went to his children with his ex wife and put into Trusts for when they're older

Inspired by a different thread I've seen tonight but made me think as I always thought it really wasn't right that the little one got nothing.

House worth around 1.5M.

Cash amount unknown but would be thousands

Does it come down to if he was on the birth certificate or not? Even though there's genetic proof and more so because a genetic test was done and the toddler inherited it (not very serious condition).

Three way split.

Didn't you ask this a couple of days ago?

The children from the marriage would inherit. This is why you're supposed to reregister your child's birth if you subsequently get married

He has died intestate so it's one for the solicitors after probate. Nearest family would be the two children. The mother of the toddler may have a claim but no guarantee on it. The ex wife would get nothing since they were divorced.

If the man is named on the little boy’s birth certificate then he should have inherited. I think genetic test results would be counted as proof of paternity.

Complete rubbish! All three children would be treated the same.

Why are people giving such rubbish advice? All three children are his so all three will inherit.

My dad passed away without a will. He had 2 children, me and my brother. He was divorced with no partner.

As next of kin, I applied for the letter of administration. The money left over all came to me, I split it with my brother but it all came to me at first. Not sure why we were both on the documents but all the money came to me originally.

Sad for the children. Hope he was a good father.

If in England, the 3 children.

If the mother of the toddler was financially dependent on him at time of death she could have had a claim. Why didn’t she challenge the division of the estate to include her toddler?
