Should pay be backdated?

Okay I'll keep it brief...

Partner started job last year. It became apparent place is chaos and the job title got stretched to cover a range of diff things. Not ideal but he needs the job. After lots of extra stuff being added onto my partner on top of his own normal work he bacame v stressed and started to detest job. CEO then acknowledged that my DP is doing way more than what he's getting paid for, then it's announced that he's getting a big promotion ( great, all good) so m DP has been doing the new role for 2 mth and as yet the pay hasnt been confirmed because the budgets are still being worked through. He's been told that it will be January.

So ... should his new pay be back dated from November or is that not how corporate companies work? ( he's been promoted to a global head of 'XYZ' from IT manager type job incase it makes a difference)

Depends how this was put to your DH, i.e. was he told at the time he was promoted there was no extra money straightaway and what they have said about backdating once the budget is signed off. Has he had anything in writing? If not then he's potentially being taken for a mug. What happens if the increased budget isn't signed off on?

This is exactly what I said to him and I'm glad you picked up on it. Nothing in writing at all so at the min it's all a case of him doing lots more extra work and no set date of when pay will be 'fixed'

He needs the job so can't be a CF but how does someone get round this?

If he has nothing in writing then I doubt he will get any back pay.

Once the salary has been agreed, I would expect it to be backdated to the start date of his new (promotion) contract (which he should have been given in writing to sign that he understands and agrees the terms of his new job role).

Otherwise they're just taking the piss and getting extra work out of him for the same money and it's not actually a promotion at all.
