How long for bank dispute to obtain money back?

Am posting this in chat for traffic - hope this is ok

Long story short I am rejecting a car with a garage who are digging their heels in and not giving me my money back. I have contacted my car insurance Legal Cover, who are "assessing my case" and deciding the likelihood of success, and that will determine whether they take it on.

As a separate avenue I have also contacted Lloyds to raise a chargeback dispute (payment was made by debit card). They will take 5 days to review the evidence I have provided, then again if they feel there's enough of a case will initiate the dispute.

Has anyone ever done a dispute for a chargeback with a bank (for a debit card) and can advise on how long it took - have tried to google but have not found much.

Oh and I forgot to add, the garage are wanting to charge me storage costs per day hence why I would like to get all of this resolved quickly. I was happy to just trot along the legal route and it take as long as it will take, but those storage costs per day £££ will add up over time!

was the seller commercial or was it a private sale via the garage?

It absolutely depends on the case. If they do give it back to you, they’ll write to the garage and give them 30 or 45 days to dispute the return, and if they submit suitable evidence, it could be taken again.

Have you had any legal advice?

Sorry, not quite a "garage" but a car supermarket type place.

Hi @YouveGotAFastCar I have spoken at length with Citizens Advice and also the initial legal advisors from my Car Insurance firm, am waiting to hear from the Solicitors who the car insurance forward their cases to.

I think the key factor will be how long from signed purchase and delivery to refusal and whether you drove it off the lot? Most legitimate on-line auto supermarkets give you 1-7 days to reject even if you drove away. Did you reject in writing?

Hi @SOBplus picked it up on the Friday, broke down on the Sunday and emailed the car place on the Monday morning to reject. car is 4 years old, bought for £12,000.00 and aa said it was clutch pedal/sensor which was faulty. garage have disagreed with this and said it is the battery. my local trusted garage have advised problem is unlikely to be battery, so I am still proceeding with rejecting the car. (which i was happy to do down the normal formal routes however now the car place have said i will be paying storage costs from friday).

They seem to be lying sods, it can't be the battery unless the alternator is faulty too. What does the contract say about terms and conditins? It sounds like they are going to try and bully you into accepting the car as they have nothing to lose but without the T&Cs it is going to be very tough to offer advice.

Hi @SOBplus thank you for your useful input - my local garage seem to think they are trying to have me on too!

so basically I am trying to reject the car under the Consumer Rights Act 2015 but I've read on some forums it can be lengthy, so now I am also trying the bank route.

If anyone has any experience of obtaining a bank refund and how long it took, please let me know :)

My bank experience was open and shut with investigation and refund in 7 or 8 days total but not involving as large a sum as a car and not with a bunch of lying sods so your case is likely to take much longer but pursuing multiple avenues simultaneously seems wise. I feel angry on your behalf that they are blatantly lying as that story about the battery is very very clearly a falsehood.
