Quit job during probation and now they're threatening to sue me?!

I have NC for this for obvious reasons. 3 months ago I started a new job, 6 months probationary period. It's become glaringly obvious that the working environment is not the right cultural fit for me and nor am I the right cultural fit for the working environment. It's a part-time job (I was slightly iffy about taking a salaried role if I'm honest because I'm so used to being my own boss now, having been self employed for years, but the money was good and they promised me a load of flexibility which hasn't materialised) and the rest of the time I am self-employed so my plan is just to continue with being self-employed (I have a waiting list of clients so this shouldn't be an issue). I've given my week's notice per my contract and they asked if I would stay until they recruited a replacement. I declined politely, as I'm in now way legally obligated to stay longer. They've kicked off and threatened to basically sue me for wasting their time?! They don't have a leg to stand on surely? The contract specifically states, 6 month probation period, 1 weeks' notice.

It was my line manager who said it but she copied in both HR and the CEO

Reply politely saying you have complied fully with the terms of the contract and suggest she might like to check them for herself. She obviously has no clue what it says.

If I was the HR Manager that received that email, I’d be calling the manager in and reading them the riot act!

Youve given sufficient contractual notice so there is quite literally nothing that they can do. Just leave on the date your notice expires and sue them if they attempt to withhold any payments from you.

Oh that’s really going to make you want to stay!!!

I think you are correct to leave.

I feel like employers always seem to think the only purpose of the probation period is for them to assess the employee, and neglect to remember it works the other way as well.

Yes! So many employers assume this.

It's the same with interviews. Ive actually been tutted at over the phone when turning down a job offer. It's bizzare.

OakElmAsh · 29/09/2023 18:23

Ops employers don't have a toe to stand on, never mind a leg

But I will be forever grateful for this thread which had me Google what Arkell v. Pressdram was, and this will henceforth be part of my repertoire of thinly veiled insults 😁

There isn't.

Don’t give it another thought.

Although I confess I’d be tempted to ask them on what contractual grounds they plan to sue.

I would ask this too. You can sue someone for wasting someone’s time.
you’re not in breach of contract nor do you have any legal duty of care towards them.

underneaththeash · 29/09/2023 18:42

Can’t sue

Maybe get this moved to legal ?

However I would refer them to Arkell v. Pressdram.

I’ve been a lawyer for 15 years and this is the first time I have ever heard this!

Amazing. Shall be used daily from now on 😂

Arkell v Pressdram - classic 🤣

Re return of laptop, it’s standard practice that they will send a courier to collect. That’s what’s happened to me on FTCs, just make sure you keep evidence it was collected. Luckily I have a ring door bell, a previous company tried to say I had not returned, I sent them the clip from doorbell with the DPD van, DPD courier in uniform carrying the laptop and screens to his van. Also it had the sound, luckily I didn’t say what I thought about the company out loud 😆
