Universal Credit question

wineta · 23/09/2023 17:16

We currently receive Child tax Credits and have received the letter re swapping to Universal Credit.

However, I think we're going to lose it all due to the savings issue BUT the savings we have are not mine, they were an inheritance for DD. The problem is, she wasn't born at the time and so they were left to my 'issue' which I believe is what you call an unborn child. As such, I received the money which I put into a savings account in my name for her when she's 18.

I've tried to call UC but not managed to get through. I'm panicking now as we really need the Tax credits/UC money to survive.

im not sure if anyone on here can help or reassure me.

Are you sure? I thought the transitional stuff was just income. As I said willing to stand corrected but that is a slap in the face for those of us losing out because we receive student finance for a part time masters! We lose 30% of our loan even though its a loan and will be paid back, and yet someone can keep their savings!

Sounds like op put it in her name though so not still in the trust fund ?

Yes, @Babyroobs, that's what I'm wondering.

Definitely applies to savings.

Also op I wouldn't bother wasting time trying to ring UC helpline. The advisors are only trained on the very basics and unlikely to know about stuff like this. Your best bet is speaking to the help to claim line ( who operate through citizens advice ) or Citizens advice themselves.

OP, I think you've obviously had a lot going on, and perhaps had a probate cheque given to you with few directions and precious little legal advice. If it's a large amount, I'd take legal advice now, irrespective of UC migration.

TheSnootiestFox · 23/09/2023 19:15

Wow 😳 OK then, sorry to hijack @Babyroobs but you clearly know your stuff 😉 genuinely why is a student loan classed as income when it's a loan? My award is only 4 and a bit k a year and if I got a car loan for that amount it wouldn't be an issue. I'm so cross!

Thank you - I'm going to get in touch with the solicitor that dealt with things and take it from there.

im going to leave the thread now as I don't have anything to add and find some of the insinuations unnecessary and insulting.

Thank you to those who offered helpful advice.

Your student loan is for living on?

Because it's money to live on so is deducted in full from any Uc award. It wouldn't be fair if older students with kids got their student loan and UC and younger ones straight out of school only got their student loan which they have to pay back. If student loan wasn't counted as income then mature students could just live off the UC and get their degree fully funded for free ?

The fees for my course are more than my loan. And even if they were, that argument doesn't make sense 🙄

Is this for a post graduate course ?

TheSnootiestFox · 23/09/2023 19:31

But it's a Masters, so the fees and 'living' come out of the same loan and in my case the fees are more than said loan, yet they still deduct 30% of my loan from UC. I can understand undergraduate where the two elements are distinctly separate but not postgrad!

TheSnootiestFox · 23/09/2023 19:33

Yes, and thank you for your help btw, I'm just hacked off with it as it makes no sense to me 🤣 x

Sorry didn't realize it was post grad, so yes I think that's treated differently.

I'm not trying to pull anything, I'm trying to protect dad's inheritance. It was fro. A grandparent who left a sum in trust for my son and as I was pregnant at the time for my issue. Sadly, they died before dd was born. I thought by putting it in my name, it would be safe for her. Obviously, didn't know x years later, this savings rule would apply.

I have the will and probate and all paperwork etc so I will try and speak to them and see what the situation is.

I'm pretty sure that ehally (and morally) can't touch her money and so if we lose the UC then so be it although it will be tough.

And to those people saying I'm trying to screw the system, please dont judge me by your standards

My standards are working full time for 43 years…never claimed a penny off the tax payer, certainly never inherited anything, done it all myself thanks very much, and that 43 years of tax and NI goes to someone trying to ‘protect’ an inheritance to n unborn child lol 😂

That doesn't make you superior in any way.
