Is my husbands insurance going to go up? Crash

He's only been driving 4 months. Is 40 years old.

His insurance is already crazy high because he's a new driver.

Today he was letting someone out at a junction and the guy behind was super impatient. He started beeping and beeping. The lady went in front and then when we started to drive the guy behind pulled onto the wrong side of the road on level with DH, who slowed down, and the guy was beeping his head off. He then accelerated and swerved infront of DH and slammed his brakes on!

DH went into the back of him.

3 different witnesses came running over and gave DH their details saying this guy was in the wrong and crazy. This guy was getting in DH face and was even winding him up when the police were there!

Police said its a civil matter, surley that's dangerous driving?!

If his insurance goes up we will have to sell the car. We can barley afford it now :(

For clarification this guy pulled alongside DH, beeping and driving down the wrong side of the road, near a school! Then sped up and swerve infrobt of his and slammed the brake in to a complete stop.

He then got out of his car and started filming us and the cars like we were the cause of it?!

Probably will go up at renewal. More often than not does when there's been a claim.
How much is anyone's guess though

What an arsehole. I don't have any advice but I hope that with all the witness statements the insurers don't blame your DH simply because he went into the back of someone. Regardless of blame though his premiums are likely to go up he's been in an accident. That happens usually regardless of fault.

I would push that with the police. It was blatantly dangerous driving and there were loads of witnesses! Making someone hit you from behind by suddenly slamming on brakes is a well known scam and the fuckers shouldn't be allowed to get away with it. If you don't get anywhere with the police I'd be contacting my MP.

It's very lucky no one was hurt.

This is awful OP but there is a very high chance your husband will be liable for this - the reasoning behind it is that you should always keep sufficient distance from the car in front to allow you time to brake if required. I know it's not fair but it will be very difficult to prove, even with witnesses.

Also I hate to tell you this but your husband's premium will go up regardless of fault.

He already slowed down to let the guy back into the right lane, there were cars behind him so he couldn't slow down any quicker, the guy pulled I right in front of him, literally inches in front and then stopped completly.

There's no way DH could have reacted any quicker or done anything different, this guy was out to cause an accident :(

We've been saving for 4 years to get a car. His lessons, the car and insurance and we are already struggling with the insurance.

If it goes up we can't keep the car.

I'm sat here crying my eyes out. Why would he do this? I don't understand at all.

All over having to wait an extra 7 seconds?!

He couldn't keep a distance behind him as the guy was pulling I from next to him, trying to cause an accident, if the guy was just in front DH would have just slowed and pulled over to get away from him but he was driving next to him the overtook him dangerously close.

I sympathise OP, I really do - it's a well known shitty trick to pull. At best, the insurers may go 50-50.

However, your insurance premiums are unlikely to go up immediately - it will happen at renewal which is 12 months for most people so you have some time.

Get everything fixed via the insurance and try and chalk it up to a bad experience. We've all had them x

It is a well known insurance scam sadly. I'd make sure the insurance company have all the witness details and hope they see it for what it is. It will mean your insurance will go up though at renewal.

If your car is fixable then the premium may go up at renewal but the value of the car also reduces so the overall cost of the insurance doesn't go up as much as you'd fear.

Maybe see if there's any CCTV nearby that you can ask for and use as evidence. Unfortunately going into the back of someone usually means you're at fault despite the circumstances.

Yes it will. Even if he's not at fault it would still go up a little just because he's had an accident which is infuriating. I had 2 no fault claims in the same year and mine went up from around to £200 to £250 at renewal. So a 25% increase for not being at fault but being involved in an accident.

When it's not clear who's at fault they usually go 50/50. Even when u know it wasn't ur fault. It's really shit.

Generally they say if u go into the back of someone it's ur fault. A friend had a car come out of no where and squeeze infront of her at traffic lights and they went in to the back of them and she got the blame!

Check your policy as they want u to report accidents within a certain time period. Say 24 or 48 hrs. If u don't report and then they do May go against ur t&cs of the policy.

Get a dashcam too. This cld have helped prove who was at fault.
