If I don't pay my rent-will I get in trouble ?please advise

I live in a upstairs flat
Downstairs is another tenant.
This tenant has dumped rubbish around the side of property -including a old front door with his number on and bags of rubbish.
The fence around the side of property leads on to the same housing association as mines multi storey building gardens.
They aren't maintaining the garden at all and a tree has grown on to my roof causing extreme noise.
I can't sleep and it's damaging the roof.
I told the housing association who told me till the rubbish is moved they won't do it.
I explained it's his rubbish (the door as his number on) they tried to get In contact and his ignored them.
So I moved as many bags as I could (which were covered in maggots /spiders and god know what else ) but I can't move the heavy items his left (and why should I )
The housing association have said the bins are filled with the wrong rubbish (his bins ) and till they are put in the correct bins they won't carry out the repair.
I opened the bins and there's all sorts in there and I'm not touching it (maggots -spiders etc and god knows what )
She said it's a tenants responsibility to move rubbish
So I told her I agree and as a tenant I dispose of my rubbish accordingly and asked why my repair isn't being carried out because downstairs doesn't do the same
She had no reply
He has dumped a sofa too and chairs etc which she told me I can pay to have removed
I can't afford it
It's just driving me mad
I'm not sleeping because of the noise
Do I stop paying my rent till it's sorted ?
What do I do ?

Yes you will be in trouble.
Speak to your local councillor. Make an sppt or go to a drop in

I'm honestly at the end of my tether
It's the lack of sleep that's just making me feel terrible.
I've tried ear plugs ,white noise but the noise it's like smashing tiles all night long when it's a little breezy.
I just don't understand how they can ask me to remove someone else's rubbish
It's not mine,the front door as his number on yet he can just leave it in and I have to pay £30 plus to get it removed
I actually don't understand how the door was left there when the H/A put a new front door on

I don't know if it will do any good but could you contact the environmental health team at the council who may enforce removal of the rubbish on the grounds that it is a health and safety issue?

Can you not get some extendable shears, lean out the window, and trim the bits that touch your roof?

That's what we did with a neighbour tree banging on our window.

@dafttomtom unfortunately not as the windows are at the front and won't reach around to where the tree is
I have thought about climbing up the tree myself and trimming it back but scared incase I fall

Withholding rent is not the answer.
Find out what legal / official routes are available to you - HA complaints dept, council, MP, etc - and get them to create waves for you.
Get the HA to put things in writing so you have evidence instead of I said / they said.

If you withhold rent you can be evicted and not rehoused. Contact your local councillor and see if they can intervene.

Put your concerns in writing to the Housimg Association and ask them to set out in writing what they intend to do about it. It the other tenants responsibility and the HA need to take enforcement action. If that brings no joy then write to your local MP. It's the sort of thing they are paid to help resolve for constituents. They will also be able to advise you of the correct steps to take.

@justasoul they've now said it can be cut down but not till rubbish is removed
I don't even think there was any nesting birds
I've looked into getting it trimmed back myself but can't afford it

@saveyourtears it did seem like they were looking for an excuse last time… I agree with the advice upthread, complain in writing to HA and environmental health and then escalate to councillors/MP.

Don’t stop paying your rent as you don’t want to get into trouble.

I would ring the council/environmental waste and explain that the HA will not remove it as it’s all in the wrong bins etc.

They may see it as fly tipping and tell him to move it or get a fine.

If your council uses the Love Clean Streets app, can you report it through that as fly tipping?

Get in touch with Environmental Health. A neighbour dumped a load of stuff in a communal entry (not HA) and they sorted it all out.

I think they have him a warning to remove it (an EH officer visited) but he didn’t so the Council came. Not sure if he was charged but who cares.

I gave my name and details initially but everything was kept confidential and there were no repercussions. It didn’t take long to sort.

Really embellish the unsanitary side of things though and I’d be inclined to throw in a fictitious rat sighting if it’s bags of rubbish. If you don’t get it sorted, it will come to a rat infestation in any case.

Environmental Health were surprisingly helpful! Good luck 😊

Unfortunately until you remove this rubbish
Regardless who's it is we will not be carrying out a repair

Contact environmental health along with your local counsellor and complain. Keep at it op.
