Where do I stand with this ? Housing association not fixing repair!

I live in a upstairs flat which backs on to a garden of a multi storey building garden (my flat and building both the same housing association )
There is a really large tree that has grown over the fence and is resting on my roof
Really heavy branches
Any slight breeze and it's knocking my roof
It's stopping me sleeping etc when it's windy
I can hear the tiles being battered around up there
The housing association sent out the ground maintenance team who said they couldn't access the tree because of rubbish in the back garden.
Now the back garden has bin liners(from previous tenant ) ,a front door with the downstairs numbers door on,a lawnmower
This isn't my rubbish
They have said unless it's moved they can't access it
I can't move it -surely they should ?
I can't sleep with the noise -
What do I do ?

Just to be clear - do you have access to the garden? And they’re telling you that you will have to clear this rubbish other people have dumped in the shared garden before they’ll fix the roof?

I have moved some of the bin liners and put them in my bin (with gloves as they had maggots and al sorts on them )
But the large items like downstairs actual front door I can't move it
Also his old lawnmower etc
I just can't get rid of it

You need to clear your garden OP. Get someone in. When I took on my house it was up to me to get rid of all the crap left behind.

You can put the lawnmower and the door up on freegle as long as you say it's not working uour covered and scrap metal people will take it

Is there much rubbish left?

@gamerchick I have moved the bin bags into my bin and even my mum took some to put in her bin but there's a front door with downstairs number on which I'm not sure why it's even dumped there -surely the h/a should of removed it when they did his door

Ahh that changes things slightly in that case they should remove it and charge the previous tenant for removal

@Theunamedcat there's a front door /the lawn mower and a couple of large boxes but I can't move them as they are falling apart and waterlogged and crawling with spiders /maggots etc
I've knocked downstairs put he ignored me

Yes, in a bad storm that could come down. But then they'd have to pay for a new roof!!
Have to spoken to the person who's rubbish it is?

Yet the front door has his house number on and the lawnmower is his
But I can't prove it

You should not have to clear another tennants' rubbish, HA I am with arrange for collections then they charge the tennant or ex tennant who is responible. They call it an inventory.

You have a few options

  1. Contact Shelter.

  2. Contact your local councillor for the area you are living in, their name and contact details are on their website. They can put extreme pressure on HA's to get them to basically pull their weight and stop messing tennants around.

HA have come under some extra pressure from Michael Gove Secretary of State for the environment after some bad publicity one HA in Rochdale caused them selves, I don't wish to digress.

They can not refuse to help with this situation, on the off chance of a storm happening and the extra dangers that may cause to the roof over your flat. After all, it would cost the HA less money to get some one to cut those brances rather than risk the repair of the roof as well. They may need to hire a tree surgeon.
