Anyone ever issued a money claim through the courts online?

Don't judge me, I know I've been naive.

I bought a watch on Instagram for £250 through my bank. Not credit card or PayPal sadly.

The seller kept fibbing me off for weeks and when it finally arrived it didn't work!

She refused to refund me, I've even returned it to her so she can see it doesn't work but still refuses to refund so I've opened a money claim online through the government website. It's cost me £35 to do so.

I'm just wondering what my chances are of getting my money back? Does this usually work? I can provide all messages and proof she's got the watch back.

Yes 3 times as a small business with poor clients.
1st paid immediately plus the 35 for the claim.
2nd paid the deadline day
3rd it got escalated then they paid.

Where is the seller based? I would imagine that would have a huge impact on the success of the claim. Are they registered with company house? Using a hire a uk postal address in Uk but actually based abroad etc? Hard to advise without knowing that.

Sorry if this is not what you want to hear. I am assuming you are in England.

Basically the seller could be based anywhere in the world. The English court will not have the jurisdiction to force a seller based in the USA (as an example) to refund you. Hopefully the seller is based in the same country you are in but I fear you are after throwing good money after bad.

You mention you transferred money via the bank. Was it a domestic or international transaction? Did you check before paying for court action?

Sorry if I sound harsh but I wouldn't get my hopes up.

@purplecorkheart She lives in london. I have her address and she even sent me a photo showing she had received the watch back so no problem with her address etc.

She's actually said she will refund me when I've closed the case!!! I've said I can't close it until she's refunded me but she's just refused again!

Had to do it twice to business clients. Both paid up before the deadline. It's amazing how galvanising the threat of court action can be for bad payers. I hope you get your money back.

Not a small company, more of a nationally known company, but yes.

I submitted the details online, I was then contacted directly by the company within a week or so, so ask where they could send the money to.

4 days after making the money order, she paid!! I'm so pleased. Even though she kept trying to make me close the claim stating she would pay after! So glad I didn't cave in.
