Wayleave request - any experiences?

Have received a package from OpenReach which is a Wayleave request - to install a bloody telecoms pole in my back garden!

Firstly, on the map/diagram, the location is in the middle of a large decked area.

Secondly, regardless of the location, I don’t want a flipping pole in my garden.

Has anyone had any experience of these requests? Can I refuse? Am I going to create a load of trouble by refusing? I have no spare funds to start paying for a solicitor etc.

I think you should speak to whoever sent it to you. Don't sign it but don't ignore it. I am sure they would want to understand your objections, if you ignore it I think they can seek permission through the courts.

Tell them no and maybe contact your home insurance? I doubt they would want that.

We have three posts in our garden already and a guy turned up last summer to put up another one. We said no and that was fine, they found another way to make it work.

Agree you shouldn't ignore it but make them come round to show them how it won't work for and they can sort it out some other way.

A wayleave doc is to ask permission OP. You can just say no and the planners at OR will have to plan an alternate route.

Thanks all, definitely won’t ignore it and I’ll give them a call tomorrow.

You can refuse it's your property. They should offer payment though, so maybe find out how much Incase it's worth doing?

The payment is £157 - definitely not worth it! Now, if it was enough to clear my mortgage I might consider it 🤣
