Surely this isn't correct?

My DP works for a council.

He's been there for less than 26 weeks.

They've told him today that they can only give him one week unpaid paternity leave. Is this correct?

I thought everyone was entitled to the two weeks paternity even if it meant being unpaid?

Someone please help me understand this. I've tried googling the answer but not sure what to think.

I think it comes down to how long he has been employed.

Less than 26 weeks. Started at the beginning of March if that's helpful.

What does it say in his contract?

It’s easy to find this information on the government website Here

Thank you for this.

Looks like he's not entitled. I'm devastated. Ah well!

It's true.

I knew a lecturer whose wife was pregnant and he ditched the university last minute as they wouldn't grant him any paternity leave for the same reason, and went to a new uni.

It was a huge loss because he was an excellent lecturer.

Winter2020 · 21/06/2023 17:51

Can't he just take a second week using his annual leave?

They said he can have a weeks annual leave the second week in august. But we're due for a scheduled induction the last week in July. So he might have to go back to work for a bit.

It's just really sad that dads don't get the same. And I don't blame him for leaving!

Hi,
I looked at Patental leave rules and it says you have to have been with the employer a year to be eligible. Could be useful in the future though.

This might be worth bearing in mind:

I think if any circumstances meant you physically needed your husband present (rather than just preferred him around) then perhaps ask (or tell them) under this policy at the time. I think if he is needed he would have to tell them that and they would decide how to administrate that. I can't see a Local Authority employer doing anything drastic if your husband is needed and can't get into work.

Time off for family and dependants

Your legal right to time off to care for dependants - when you can take time off, how long you get, your rights

He's going to ask for a weeks annual leave and a weeks unpaid parental leave if that's possible.

He has a week off in august, so he's also going to ask if he can add that on to his paternity leave so he doesn't need to go back to work for a few days then go back off again.

God I didn't realise how stressful it was to sort this. Organising my maternity leave was so simple!
