What do you do when he won't leave?

Massive row, I want to split up. He won't leave. What do you do?

Is the house in your name, his or both? If its in yours, phone the police to remove him.

If its shared or in his, take the child(ren) somewhere safe.

Whose house is it ? or if rented then whose name is the tenancy in or joint?

You leave in that situation then? If you're both on the mortgage I don't think either of you can force the other out.

Sounds like maybe he's still in shock at your decision. how long ago did you tell him ? Maybe he just needs a bit of time to get his head round things then will be more reasonable. But half the house is his so I don't think you have any right to ask him to leave when you could leave. Are the kids his?

it might not be a quick solution but have always read it’s bad advice to leave

Ok so if the row was just now he needs time to get his head around things. Saying he is not leaving is possibly a knee jerk reaction and when you've both had time to calm down you can hopefully come to a sensible plan. if neither can afford to take on the mortgage alone, one will need to buy the other out of the property.

What's the situation with the kids? Would he be responsible and pick up the parenting if you did leave?

Let things settle and whilst you do, get some proper legal advice. I think you can force a house sale.

You need to sell the house and split the equity.

You can't force someone out of a house they co-own.

Rows are part of marriage and marriages have ups and downs.

I've threatened to leave DH In the past and I once went to my dad's for a fortnight to get my mind clear. I came home and he was so apologetic about the behaviour that had forced me to make the decision to go home and he no longer does it.

We've been married for almost 34 years and we're mainly happy together.

Sounds like OP is not married though, so just have the house to sort, no other legal entanglements.

My ex refused to leave. My mental health started to deteriorate so I went into rented with the children. In the divorce we sold the house and split the equity

Me too. It did me no harm in the long run to leave. The house belonged to both of us, and we were married.
