Can new job do this?

Recently got a new job with a start date 15th of May. Contract has been signed. References collected. Etc etc. Today I had a call to say they are really sorry but the position is no longer available. I’ve handed in my notice already! Spoken to my boss who basically said I’m now a flight risk so can’t stay in my current job either. It feels like my whole life has been blown up

What does your contact say about a notice period? Surely they’ll have to pay you some sort of notice

Your current boss just sounds bitter you want to leave. I’d have thought in their best interests to have you back to either a) promote you or at least ensure your career goals are being fulfilled or b) steady the ship until such time someone new comes along.

That’s a shitty position you’ve been put in. I’m sorry.

They say they don’t have to pay notice because the contract hasn’t started yet. I should never have taken this job. 😭

This is the important bit I think. If they've got to the point of a start date and signed contracts then they are already in a contractual relationship with you. To end it they need to give you the notice specified in the contract (probably a month?) or give you "pay in lieu of notice" (one month's wages).

That's not great if you are left out of a job, but it's better than nothing. Although (a) I'm not an employment lawyer, and (b) actually getting the money from them is a different matter.

Contracts are usually set so that in the probation period, the notice is just one week. So they should still honour that at least, or pay you in lieu of notice. Shitty situation though!

On the plus side, you could make yourself very attractive to other recruiters because you'll be immediately available for a very robust reason (which can be evidenced)

The problem I have is we live really remotely so I need WFH jobs which has never been a problem. All of a sudden there are very few about! So I feel quite panicky. I will speak to them about payment in lieu of notice although I’m not sure how far I’ll get!
