Extra bank hol for P/T workers

Hello! I just wanted to check something. For those of us who do not work Mondays usually, are we entitled to have an extra day of leave added to our allowance due to the extra BH for the coronation? My contract states I receive annual leave pro-rata. My workplace will be closing on that Monday (we always close for BHs) so it seems unfair that my other colleagues will receieve this day off paid whereas id only get the usual allowance? We do not have a HR department however the business manager got back to me and said as it's normally a non-working day I shouldn't be entitled to it.

We always give part time staff 1/5 of their usual week off if there’s a bank holiday in it. Eg if you work 15 hours per week regardless of which day you only have to work 12. I think that’s the fairest way of doing it.

In our workplace part time workers will get the pro rata additional hours to take even if they're not working on the bank holiday. I work Mondays and will lose around 3.5 hours of my annual leave entitlement for the additional holiday as I am part time but have to take the full day. Ho hum, better make the most of the day off!

Appreciate that only works if shifts don’t have to be covered, we’re all office/home based with our own tasks and not customer facing so it works

It's not supposed to matter which days you work. Every pt worker should receive a pro-rata allowance for bank holidays which is the same whether they work MTW or WThF - if you work MTW then your leave allowance increases by 0.6days for the extra BH but when the office closes for the day you have 1.0 days deducted so 0.4 days comes from the main Annual Leave allowance - which will be annoying for any workers who have already planned how to allocate their annual allowance. If you work WThF you are supposed to still get the 0.6 days added but may be able to take it whenever.

This isn't discretionary, it's illegal for part time workers to be less advantaged than Full Time, but there's some flexibility as to how it's applied e.g. you may be required to take the 0.6 days within a week of the extra bh.

You will automatically be allocated a pro rata amount of hours within your allowance

This is the law and is often a source of confusion

@CoozudBoyuPuak thanks, this was my assumption too! I've been told twice now by the general manager and now business manager that as it's a non-working day for me I'm not entitled to it. But that's not how pro-rata works! Annoying as I'm the only one who does not work Mondays so it's an anomaly for them to work out. She did mention she will need to speak to the business owner as it may be up to their discretion Confused. Is there any reference I can point them to, to explain?

I think the fairest way is to give the pro-rata equivalent of the extra day. Usually PT workers only get the pro-rata of the 8 bank holidays, so the fact there is an extra BH, means that you get a percentage of the extra day?

So people who work 1 day a week (20% of a full time worker) get 20% of the 8 BH's, but the extra BH will mean it's now 20% of 9 days.

So in effect, you should get 20/40/60/80% of the extra BH (depending if you work 1/2/3/4 days per week).

It seems unfair if you don't get anything at all.

Are the full-time workers definitely getting it as an extra day of paid leave? It's equally possible that the employer can be forcing them all to take a non-optional day from their normal allowance, or to have the day off unpaid.

If they are being paid an extra day of paid leave you are entitled to a pro rata equivalent.

We get extra hours added to our annual leave. I don’t work Monday’s but get additional pro rata time to take when I like. It’s a definite perk to have Monday’s off.

Also better for childcare as I don’t pay for bank hols which they are closed for!

Usually part time workers get the percentage of the bank holidays so this year there are 9 rather than the usual 8. I work 3 days per week, i.e 60% of a full time week so I get 60% of the 9 bank holidays this year added to my leave allowance. Any that fall on a day I work I take out of my allowance and if I have any leave left over I can use it on a day I choose. It's the reason I don't work on Mondays as I end up with more days leave as most bank hols are Mondays and as it's not my working day I don't have to take them.

@CoozudBoyuPuak yes the FT workers are definitely getting an extra day of leave paid. Hence why I've asked for them to look into this for me as I shouldn't be disadvantaged comparatively! @JustGettingReady thanks, that make sense. This happened to me also when there was an extra bank holiday for the platinum jubilee last year but I was leaving the place and couldn't be bothered fighting them over it. I think the lazy response is always 'no cos that's not your normal working day' not taking into consideration its pro-rata regardless!

Yes as a few of you have said, I wanted to take Mondays off and most of the BHs fall on this day and I wanted to use my leave when I wanted. It's worked nicely so far, except when we have these extra ones added!
