Changing child's surname

CoffeeLover90 · 31/03/2023 13:54

Child is 3 but unaware of surname. His dad is not in contact, likely never will be and is not named on the birth certificate. At the time of registering his birth I gave him ex's surname. I'd like to change this to my surname before he starts school. Do I need to apply for a new birth certificate or go through deed pool? If deed pool does this over ride the birth certificate so he will have my surname once his national insurance card arrives? I've googled and I've found it very confusing.

I imagine you'd need a deedpoll. Luckily his dad is not on the birth certificate as that could have caused issues

Yes pretty straight forward given he is not on the bc, not sure why you gave him exes name sounds like he has never been around if he isn’t even on the bc but yes change it asap. Bc wont change though.

You will need to change it by deed poll.

Every time your DC needs to prove their ID they will need their birth certificate and deed poll. So the best thing you can do is get your child a passport once you have done the deed poll so they can just use their passport as ID instead.

Change by deedpool as his father isn’t on the birth certificate

mine is David Jones smith at school Jones bring me and Smith his father but he hates smith so he write David Jones on everything as his father is on the Bc and will not consent to it being changed

Thanks everyone, I just wanted to make sure he wouldn't have his name changed back to birth name later in life once he gets national insurance. Long story with the dad but thought it best to update the name before school and his first holiday abroad next year.

Once he's changed his name if he gets any government document sent in the old name he just needs to contact them and inform them his name was changed by deed poll in 2023 when he was 3 and his other ID, bank account, etc are all in his current name.

They may then ask for a copy of the deed poll or other proof but they will change his name.

Myself and several people I know have modified/changed our names since childhood. It is more difficult now and because some of us didn't/hadn't needed to use deed poll it causes issues randomly.

Thank you. I'd been confused as I was given my step father's name as a child and when my NI card arrived it was in my birth name. I continued using my birth name from then. As it sounds it doesn't appear my mum changed it via deed poll, my uncles was changed as deed poll as a child (just found out today) and has continued with the updated surname, married etc. So deed poll is the way to go, I'll use the gov website, wary of the free and reduced services.
Thank you again for the advice everyone.

Yep. Similar situation and I changed my son's name by deed poll.

I had to sign a declaration that he'd only go by new name and that there was no one else with PR.

Whenever asked to present his birth certificate (eg applying for a job), he provides both the BC and DP. He's in his 20s. Never been an issue Smile

That's exactly what I needed to hear. Thank you. Reading the information online had been very confusing as didn't really specify what happened in future.
