I own a business and 2 years ago I was really busy so I asked another company if they could do some work for me, I know this other company and we see each other through work occasionally. They were happy to do the work and was all completed to the customers satisfaction.
Today I received a letter saying the work has been found to be substandard and has caused damage to property. The subcontractor is named but the letter came to me.
Who is liable to pay the insurance? Me or the subcontractor?

Against you
and then you claim against sub contractor

Yes this is correct.

Thankyou. It's a small domestic trade business. The damage is for a ceiling that has been damaged due to a leak. Now, considering this work was done 2 years ago I only have the customers word that my subcontractor has done something wrong. The first I heard was a letter from the customers insurer.
I would have preferred the customer to contact me so I could view the damage.

They probably didn't know it was the subcontractors work that was the problem, hence contacting their own insurer. It's probably the insurer who's inspected it.

TBH, Quite telling that the customer decided to bypass you and go straight to insurer for them to communicate with you

I just wish the customer had spoken to me first. After over 2 years its the customers word against mine. But I would 100% put things right if I was able to.

Yes but the customer obviously didn’t want or feel comfortable for some reason to go direct to you

Thank you, this is the first time in my long career that this has happened. I pride myself in my 5* reviews. I need to be careful about using subcontractors again.
The cynic on me is wondering if the customer is trying to make a quick buck

After 2 years I wouldn't automatically assume faulty work. I'd go to the insurer rather than someone who did work on my property 2 years ago.

On what grounds?
