If you received £10k interim payment for an accident that wasn’t your fault

Can’t say - it depends what the interim payment is for. It might be to cover legal fees, it might be to adapt your home for a wheelchair, it might be to pay for therapy…

Discuss with your solicitor. Compensation is calculated on loss of earnings/future earnings, rehabilitation and care needs, emotional impact and damages. These will all need to be documented and proven to be accurate with relevant evidence.

There will be deductions from the final figure ; any benefits claimed whilst recovering, solicitors fees and your 10k interim will be taken off.

An interim payment is not a set percentage of final settlement.

Look at case studies of similar accident compensation payouts to your own to give you a very loose indication.

Bear in mind that although a claim is on a No win, No fee basis, there are hefty legal fees once a “win” is secured.

The good news is that an interim payment indicates that the prosecuted party has admitted liability (fault). This can be full or partial liability which will affect final compensation.
e.g 50% liability means only half of the final settlement goes to the injured party.

Thank you. I wasn’t sure if it was a percentage or not, soo you’ve answered my thoughts.

Third party have accepted full liability. Car accident resulting in shoulder surgery, at least 6 months off work and therapy due to trauma.

I hope you get the compensation you deserve. Cases can take a long time to resolve so it’s great you’ve been awarded an interim payment.
I’d say don’t be afraid to ask your solicitor (or case manager?) any questions and request regular updates on your claim. Good luck 🙂

I ended up getting 3 small interim payments as it took over two years to settle. In total they worked out at about 10% of the award but I had to really push for those payments, especially the last one.

The other side admitted liability, I had therapy etc but it still took a long time to resolve. I hope you recover soon Flowers

If you claim PIP you have to pay it back once you get your final award.
