Will this definitely be filtered out on enhanced dbs?

A caution for common assault in 2007

Im aware in 2020 that some cautions etc were taken off the list of things that would show up and CA was one. Is it definitely 100% that this will NOT show up on an enhanced dbs? I just want to make sure

There’s a discretionary element to DBS checks depending on the context of the offences I think. If you’re worried about it then your best best is to be transparent about it before the check comes back imo, just in case. If you google disclosure and barring there are some useful sources of information out there which might give you some clarity.

Thanks. It’s so hard to work out . I’m pretty sure it won’t show but I want to make sure 100%

It shouldn’t show up in the main bit, but your local constabulary can put things like this in the “any other relevant information” box if they think it’s relevant to the job.

Depends if it’s assualt is an offence which can be filtered out after six years or not.. full list of stuff which stays for ever here by the look of it. assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/635719/List_of_offences_that_will_not_be_filtered_1.docx

You will never be sure it wont show up on any enhanced DBS, it might not show on some, and then show again on others.

If you are getting a DBS you will need to be transparent about this

I would be honest and tell the employer that there is something that may show up, that it was many years ago and isn't a reflection of the person you are now. (Which is hopefully true)

No I can’t tell them. It’s very complicated and I don’t want to be judged as I didn’t actually do anything wrong although it looks like i did. I stupidly admitted to something I didn’t do 😞I just want a job and to not be judged I’m hoping it won’t show I don’t think it will due to the changes in 2020🤞

My ex was emotionally abusive . Occasionally physical. Lots of gaslighting. He decided on one occasion after a row when I answered back and stuck up for myself and he felt humiliated to make a false report that I had attacked him. He didn’t even have a mark on him and I was arrested and my baby was left with him. I was terrified. After a few hours I asked ‘what do I need to do to be allowed to go asap?’ I was told if I accepted a caution I could go . The officer joked that ‘it won’t mean anything unless you want to go and live in the USA!’ So I accepted it and was allowed to go. I didn’t realise till a few weeks later I’d made a huge mistake I just wanted to get home to my baby to make sure he was safe. It was so long ago I’m just going to hope it wont show up as I can’t go through it all with people it really distresses me

I’m sorry OP, that sounds awful. Looks like you can do a subject access request thing to ask what is held on record? Is that worth doing?

I’ll try that

I’ve not had a job since then and now seeing in 2020 things were added to the filtered list I’ve been applying and I just want a fresh start

You can also apply to have incorrectly issued cautions removed from your record forrestwilliamssolicitors.com/services/criminal-defence/caution-removal-solicitors/
