Low stakes question about who is to blame for car insurance purposes

Had a near accident today as I drove round a left handed blind bend in my village and narrowly avoided hitting a parked car on double yellow lines. The double yellow lines being there as it was an unsafe place to park right on the bend.

If I had have hit this car would it have been my fault for car insurance purposes?

The insurers (or their subro solicitors) would argue it out with various points on either side :)

I think it would have been your fault. You shouldn't be going so fast round a blind bend that you can't stop if there's something unexpected there. What if a child had been crossing the road, for example?

As I understand it driving into a stationary object fitted with reflectors, because you were driving too fast for the visibility round the corner is going to be hard to defend.

If the same car was in the same place, but with a driver behind the wheel and had stopped for whatever reason would you still question fault if you drove into the back of it?

Sorry. Subrogated recovery solicitors. Insurers have a panel of solicitors to appoint when they can potentially make a recovery from the other side of what they've had to pay out.

I think it would be your fault as the other vehicle was stationery- imagine they’d just done an emergency stop or something. However they are an arse for parking there- where are traffic wardens when you want them?!

Your fault. You would have been driving too fast around the bend if you couldn't stop in time. Also those with a disabled badge can park on many double yellows so don't drive around thinking there will never be cars on them.

OK thanks all. Surprised there’s not some culpability there but good points about why there might be a vehicle in that position.

Hopefully someone other than me will whizz past him and take his wing mirror off Grin
