New employer making me take bank holidays out of my holiday

As a result I only have 14 days to take for the entire year. I have kids and it’s going to be ridiculously hard to cover holidays. Never ever had this at another employer.

is this commonplace?

i can’t be bothered to RTFT but you are legally entitled to 140 hours per year. Presumably to started during the annual leave year hence only 120 hours or something is seriously wrong. And the 140 hours includes your PH.

Depends how its written in your contract? Annual leave including bank holidays or annual leave excluding bank holidays.

What days do you work?

My contract gives me Tuesdays off and they don’t want me to swap to Mondays off because there is a staff meeting! I don’t feel it’s fair that I am stuck with working mondays though, considering it eats a third of my holiday through bank holidays.

Can you ask in a bank holiday week to occasionally work Tuesday's do you can get some extra leave?

It's correct what they are doing. To be honest, for many years part timers workers, worked Mondays and bragged how they got more days off than their part time counter parts who didn't work Mondays. There are still some places who don't pro-rata bank holidays making it fair for all.

if you work 4 days a week you get 4/5ths of the bank holiday. You can’t expect to get a full day’s entitlement

Hi try and arrange your holidays so bank holidays are tagged on the end eg taking Wednesday through to Monday …feels like a week off for only three plus bh days off. Many of the bank holidays occur during school holidays so this can work a bit

Check your contract. PT is usually converted to hours which is how you will find out how many ‘days’ you get. I work PT 22.5 hours pw and get the equivalent to 6.5 weeks a year incl BH. You definitely need to check with your HR dept as what he is doing could be completely wrong

Perfectly legal and normal (and stated in contract) of your employer doesn’t open for BH… to do differently for you because you are PT would be penalising anyone who works FT….

This is correct for your employer to do this. I assume Monday is one of the 4 days you work? You would be better having Monday as your day off. This would mean you get to pick all your holidays and you also get to pick when you take your share of the bank holidays too.

This is quite normal in companies. You’re annual leave allowance should reflect the need to do this though

Yes I’m part time. Seems so unfair. I’ll literally have to take some unpaid time to cover a bit more time off. I’ve had so many jobs over my life and never encountered this. It’s so demoralising.

Where I work if you are part time you have to use your leave for BHs and the hours you work that day. So for someone who works all day on a Monday you lose a huge portion of you AL but for someone who doesn't work on a Monday you gain quite a few hours to take when you want to
Unfortunately I do work Mondays!

I work part time, and get either 18 or 19 days, not sure which. There are 2 in there for long service 😲
But I purposely don't work a Monday so that I'm not affected by the majority of bank hols.
Is there any way you could change your days to be tues-fri?

It strikes me as fair if you work less than twenty hours a week but I suspect it's under what it should be. If you are doing 4/7 rather than 5/7, your leave should be reduced accordingly. The 28 days is allowed to include Bank Holidays. Lets say this leaves 21 days. If the difference is 1/7, I would think you would have 3 days less so eighteen days? This isn't great maths but you see my ideas I hope?

You cant just "guess" and "think" when calculating annual leave.

If you are part time can you change your days so that Monday is your non-working day? It makes all the difference as then you will not have to use your holiday for Bank Hols that fall on a Monday (as the majority do)

I have not RTFT but i have experience of this.

I used to work part time. I have done various 22 hours over 3 days, 25 over 4 then 32 over 5.
Every time the annual leave was worked out in hours.
So 20 days is on 37.5 hour weeks is 150 hours.
20 days on 25 hour weeks is 100 hours. Now, this will depend on how many hours you work, but if you do 6.25 a day, which 25 over 4 is, that gives you 16 days AL. This is 4 weeks as you only need 4 per week to book a full week, same as a full timer.

Bank Holidays are normally pro rata for part time staff. So 8 days for full time staff (on 37.5 hour weeks) would be 60 hours AL but that just basically covers the Bank Holidays.
And 8 days on 25 hours would be 40 hours AL. You would then need to take these hours on Bank Holidays as obviously the office is closed.
This is when part time staff who don't work Mondays benefit as they would still get the Bank Holiday pro rata AL but not need to use as much on actual Bank Holidays - I know from experience as I used to have Mondays off.
As you do work Mondays that 40 hours may not quiet cover all the Bank Holidays and eat slightly in to your AL.
You will benefit that 27th Dec is a Tues and sub Bank hol this year, so not needed as AL as you said you don't work Tuesdays.

It is annoying though, I know a few people who are part time and have the same issue.

I have this too but its correct. Cause if youre part time you're only entitled to pay on a a proportion of Bank Holidays. Like I work 4 days a week and I am entitled to pay for 80% of Bank Holidays.

My employer adds together my annual leave allowance and 80% of Bank Holidays (theres 8 this year) then every time I have a day off (whether its annual leave or Bank hol) there's a day out of this number.

But where I work then not working Mondays you would still have a day taken off your total leave for Bank hol on a monday so wouldn't be a benefit to change tbh. Worth checking
