My former employer /fraud / using my NI

I need some advice. A company I worked for untill 2019 is still on hmrc's system. When I left in early 2019 she issued my p45 and I moved on. Due to circumstances, I had to work reduced hours and needed to claim benefits.

I declared my earning. I was informed I would be entitled to much less and asked why I haven't declared the other place I work at. It turns out was told I am down as working in two places. I disputed this but HMRC has given me information to the effect that I had income from the former workplace in 2019/21. They started an investigation back in Jan but haven't heard back anything.

I spoke to the woman I worked for and she has not been helpful. I asked why she is paying someone who is using my NI. She said that's not true. I asked for a letter confirming when I left and the date of my last payslip. She wrote me a one sentence letter with no company logo or even her full name on it.

What can I do? I am planning to speak to my mp today but this has been very distressful. Shocking that HMRC is taking this long.

I once reported something them and nothing happened, not even an email acknowledgement

Id report to the police and tell your old bss you've done it, not the wages person

Report it to the police. Identity theft and fraud.

Report it to the owner of the business too. The person submitting the payroll is likely the culprit. She's probably trying to cover her tracks now.

The person I have been communicating with is the owner. She runs the business full time and I told her to search the business records using my national insurance number but she is telling me that it would not be possible and in any case any information they find if attached to someone else would not be available to me because of data protection.

I have been looking at my tax account today and again multiple payments supposedly been reported by my "employer" of a few thousands just last month alone. On the line to HMRC right now and wonder when all this will be put to an end.

I am going to phone the police too, hopefully that will spook her but I doubt it. Could it be accountant related. She has an accountant he has denied it is a problem on the business side but can't explain why the business is reporting on a monthly basis that I am wanting there if I am not.

Thanks for all of your input, it has been helpful to see that at the very least I am not mad.

Also raise a complaint with the data protection commissioner as they shouldnt be using your details.

Sounds like they are defrauding HMRC and attempting to utilise your personal tax allowance, to pay less income tax.

It’s identity theft. Police report. Get a crime number. They will be forced to investigate.

Action fraud are useless - do not allow anyone to direct you to them.

Its HMRC fraud - raise a complaint with them.

Document everything. You might need it. Dates times of discussions, notes of what was said, anything in writing keep a copy.
