Not paying my rent ...threatening court action...

Hi I rent a housing association property.
I get paid the last day of the month.
My payroll has had issues with payments and have told us payments will be in bank on Monday.
I informed housing association I will be late by a few days this month and payment will be made first thing Monday.
The lady wasn't very nice on the phone-saying I'm in breach of my tenancy paying late and she might decide to start eviction proceedings.
Can she do this ? I pay on time every month
I pay £5 more than my rent per month also
I'm panicking now.
I'm paying Monday first thing

You won't get evicted for two days she sounds the type to write a formal letter which stays on your account though

I had one when I was on housing benefit they allocated my rent to the wrong account didn't tell me until I was a thousand pounds in arrears I rang the council in tears they told me it was fine they had paid it directly I called again they told me to "start packing" or find the money.....council were pissed rang them and corrected it while they were on the phone no apology from the housing association and the pending eviction stays on my account which means should I fall behind "again" they don't give me as many chances to sort it as I'm a "repeat offender" I'm now two months ahead in my rent and paranoid as hell

@Isaidnoalready make a formal complaint for it to be removed from your record. If they don’t do it then complain to the housing ombudsman and it will get sorted 😁

It’s not about it only being two days late,
if it was then they would have been fine, but the way she acted shows they likely have a zero tolerance policy for late paying,
in my professional experience that means as soon as possible they will want to get you out.
it’s not your fault, it’s just the way some are.

There's no chance it will go to court - you're in credit most the time and will be in debit for a few days only until you're paid.

I'd write and complain too.

Everyone is missing the main issue, her payroll dept!! I’m pretty sure I’d get a black mark against me if I never had the funds in my bank to pay my mortgage payment, I would be defaulting. Your employer needs to do a bank transfer asap.

This. The council/housing association aren't the bad guys here. If I was paid 2 days late it would mean I would default on my mortgage. Your employer needs to arrange a bank transfer.

You should be trying to get a short term overdraft or loan to make sure you pay your rent on time.

you will be in breach of your tenancy agreement and by not paying on time you are all but chances are you are guaranteeing that you will be evicted at some point.
either they will start the eviction process now or when your short hold tenancy agreement ends, is it worth the risk?

If you're two days late and your account is in credit, there is no way they will evict you. It would be daft to get rid of a reliable tenant, and the court wouldn't go along with them anyway.

It could make sense to talk to the HA about setting up a different rent payment date, maybe a few days later than the current one, so that it doesn't matter if you have a glitch like this in future.

Everyone seems to be missing the point that legally they cannot even issue a section 8 for rent arrears until she is 2 months in arrears. The women on the phone was completely talking out of her arse. There is no way she is getting evicted for paying a few days late. It is an impossibility for this to happen!

They can't even go to court, let alone say the court won't go along with them. They couldn't even lodge the papers with the court as she is not 2 months in arrears. There is nothing for the court to do!
