Can my boss take hrs off me? Help

Okay I'll keep it simple.

• i am contracted 20 hrs per week
•I had booked off Monday ages ago (family thing) boss approved this no problem
• rota was released for the week, I was accidentally put in to work Monday
• told boss, she said don't worry I'll remove you from working that day ( I was taking it as day off)
• my boss never puts me in to work another shift despite me telling her to do so.
• I'm now 7 hr short of my contract and can't now make the hrs up as I'm already in today and tomorrow. Can my boss make me take it unpaid ( I can't afford to loose the money as I'm single parent)

Do you not have paid leave to use? They are not obliged to make your hours up if so,

Skyeheather · 17/06/2022 13:09

Could you ask your Boss to put it through as holiday, so you'll get holiday pay for that day? Maybe your Boss has put it through as holiday already?

MargosKaftan · 17/06/2022 13:09

You need to ask how the day off has been allocated - is it unpaid leave or annual holiday or are you expected to make up the hours later in the month.

Justthisonceharold · 17/06/2022 13:10

I don't really understand, is it not (paid) annual leave?

Jalisco · 17/06/2022 13:10

Yes, I am confused. If this is holiday then it should be paid and you will lose nothing.

SolasAnla · 17/06/2022 13:11

Do you get paid your holiday money as you work up the hours or do you get paid when you take time off?

Jalepenojello · 17/06/2022 13:12

If it is submitted as holiday you should get paid leave, no?

Octomore · 17/06/2022 13:12

In most jobs "booking a day off" = taking annual leave. You have a statutory right to 20 days leave per year (pro rata), so can you use some of that?

flumpybumpykid · 17/06/2022 13:13

I have used all my holiday allowance for the year but I did say she could tweak my holidays if needed, for example I have a long weekend booked off but I could work my hrs during that week and take the weekend as days off.

I am frustrated that I reminded her through our internal work app that I was short on hrs and she ignored it. I'm sure I'll have to take it unpaid but it's a bit frustrating

@MargosKaftan that might have to be an option albeit that it doesn't really suit my family life.

But the boss isn’t doing anything wrong. You’ve used up the leave so she granted you unpaid leave.

flumpybumpykid · 17/06/2022 13:15

@Justthisonceharold no I work different shifts so had asked for this particular day to be just a day off ( and she agreed) but she didnt allocate me another shift to make up the hrs

OP posts:
Octomore · 17/06/2022 13:18

Would allocating you another shift mean taking a shift away from another employee?

Unless someone else was essentially prepared to swap shifts with you, what you're asking for might not have been possible.

flumpybumpykid · 17/06/2022 13:20

@FAQs yes you're right, but I asked her to put me in for another shift. ( I'm making it sound more complicated but this happens all the time In my work when people need last min days off, so normally a shift is swapped) as I had asked for this particular day off to be used as just a normal day off when I booked it, I was 'expecting' to work my 20hrs up through the rest off the week.

OP posts:
LIZS · 17/06/2022 13:21

Are you able to make up the time another week to balance out?

Octomore · 17/06/2022 13:22

In future, rather than "booking off" a shift and expecting to be allocated a different one, I would ask your colleagues if anyone will swap with you for a certain week.

Then when you talk to your manager you're not asking to "book off" anything, just saying "[X] and I would like to swap our usual shifts next week if that's ok, so she'll do Tues and I'll do Weds."

Simpler all round, and no potential for misunderstanding.

Comefromaway · 17/06/2022 13:22

She's done nothing wrong. You asked for Monday off but have used up your holiday so it has been given as unpaid leave. She is under no obligation to make up your hours by giving you another shift on a different day.

Fullsomefrenchie · 17/06/2022 13:22

Yes she can do this if it means causing an issue to someone else, you’ve basically requested unpaid leave

flumpybumpykid · 17/06/2022 13:23

@Octomore but my boss has made a small error when she was drafting up the rota. We have lots of staff that don't work set days/hrs so the rota is done on a week to week basis and people's hrs change so it wouldn't have been taking anyone's hrs (I hope that makes sense)

OP posts:
HotHeatDays · 17/06/2022 13:24

Your boss has done nothing wrong.

AlisonDonut · 17/06/2022 13:24

But you booked it off rather than swapped shifts.

And as you had used all paid leave, that leaves unpaid.

flumpybumpykid · 17/06/2022 13:32

When my manager had agreed to me being off, it was done on the basis that I still worked my 20 hrs over 3 days as normal. It wasn't anything out of the ordinary for this to happen ( we all do this and I had given her 2mths notice) but she has made a simple mistake by putting me in to work Monday, then realising I had asked for it off then taking me out of the monday and not giving me an extra shift.

I completely get it if I worked 5 days /full time but I don't. My hrs are flexible I suppose you could say. Xx

I'll just make up the hrs somehow though

OP posts:
flumpybumpykid · 17/06/2022 13:50

@AlisonDonut but I dont have set shifts so I can do any combination of 3 days . I was just asking that when it came to that week if Monday could be my day off and I'd work My (random) 3 days as normal. I'm rubbish at explaining stuff tho so I understand what you're saying

OP posts:
LIZS · 17/06/2022 13:52

Perhaps they misunderstood, or it suited everyone else to work as they have planned and cannot now swap.

fourplusfour · 17/06/2022 13:59

I understand what you're saying OP. We don't have set working days either so would just do as you did and ask for it to be you're day off. She should have given you a shit on another day.
