Housing element and UC

Not sure if anyone knows anything about this as I’ve tried to look it up and I can’t find anything
but my daughter is in receipt of DLA high rate care
I’m waiting for someone to get back to me about backdating my careers element and the child element ( i think it is) from when DLA backdated there’s
i know caters allowance is classed as income and they take it of your UC I’m currently on maternity allowance now from the government and that effects my pay too my question is if they do backdate the careers element and the child element will that effect housing element ??
mum unsure what to do now as next month when I get my statement I’m thinking the May not give me anything due to them backdating her money and I’m sure they wouldn’t pay my housing element , so confused about all this .

So, backdated carers allowance will create an overpayment of whatever amount you receive as CA is classed as an overlapping benefit. Carers element and disabled child element will also be backdated and the amount due can be deducted from the CA overpayment so you could well find you’re still entitled to a smaller backdated payment. If it ends up as a negative amount then you’ll be contacted by debt management to arrange the repayment at an affordable rate.

Going forward the extra amounts added for carers element and disabled child element will be added to your total entitlement and the CA and MA will be added to any other deductions so your overall entitlement will reduce by that total. No single element is protected from deductions so, depending on your totals, you may have to top up your rent amount

@Rememberallball yeah I understand that they said it will be backdated from 3 months so from when DLA backdated my daughters money that’s when they will do it from
I didn’t know that they would take money of me through child element ? I only thought they would do this for Carers element and my MAT pay
so confusing I will ask them wants they get back to me with a update

You need to think of it as a whole award made up of all the elements added together. Any deductions / overpayments will come off the whole award, there eis no element which is not affected. So if carers allowance backpay is for example £800 and the backdating of child disability element and carers element is £1000 ( just an example ) they will owe you £200, but the overpayment and underpayment may not be processed at the same time so there's no telling how it will be worked out. It may be that you are paid the £1000 as backpay then carers allowance back date is paid and you owe uc the £800 back and they will take it back a bit each month. Going forwards, your carers allowance is paid separately then deducted from your Uc on a monthly averaged deduction.

Either way , with higher rate DLA you are going to be massively better off with the actual DLA payments, disability element and carers elements so I wouldn't worry about an overpayment which is going to be small in comparison. The higher child disability premium alone is over £400 a month.
