Blame in car accident

DH was stationary waiting to pull out of a car park. A car then reversed into the side of DH's car. He didn't have his reversing lights on as DH pulled up the the edge of the car park to wait to pull out onto the road. This man got out of his car and said to DH "Didn't you see me?" and is now calling it "they had a collision" rather than that he drove into our car.

So I guess we have to go through the insurance as this man won't accept it was his fault so no offer to fix damage. The man hasn't provided his details yet - 3 days later. He was angry with DH taking photos of the scene and his registration number too. I'm just checking this will legally be classed as 100% his fault? Or can he claim both at fault?

Yes the car was parked. DH drove and stopped behind it waiting to leave. Other car then reversed out of its parking space straight into the side of DH's car.

I will look into the insurance, thank you. DH set it up - I usually do everything but was sick of it so made him do it - so I'm not sure he explained he doesn't legally own the car tax to the insurance company. Everyone at his company is in the same situation though, they nearly all have cars and all that do, provide their own insurance. It's probably 20+ people. I had never heard of it though.

Op has your DH reported the accident to the police as well as his insurance? Not clear from what you've put, but if the other guy is messing around oris likely to, it would be worth your DH making sure that he has reported it properly (albeit he Might already be a bit late if he hasn't already done so - apologies if he has and I've missed it).

He didn't report to the police. He's told his insurance company now and the man did eventually provide all his details, including insurance and his address. He wanted our address but DH said no.

DH said his insurance has recorded it as a No Fault Claim and will sort repairs. Just waiting to make sure the other man really does have insurance and that it all works out.

The insurance company are being lazy arses. I would not stand for a no fault collision. I might be wrong but I think that just means it couldn’t be proven either way so will likely have more of an effect on renewal prices? Also will he lose excess? What about ncb, is it protected?

100% the other driver's fault. You can't drive a car sideways.

I would check your DH is actually insured OP as as far as I'm aware you are not able to insure something you don't own. This is because you don't have the same motivation to prevent it getting damaged if you don't have a financial stake in it.

I know this as my old boss tried to get me to insure my company car myself (small business) and I rang multiple insurers who all told me the same thing - you can't insure something you don't own. In the end he had to sign ownership over to me with a legal agreement in place that the ownership would revert back to him if I left his employment for any reason.

What? It's non fault not no fault. It means his insurers believe he's not at fault.

I agree - it’s a no fault claim - not your husbands fault.
It means the insurance pays the repairs and claims them back from the other insurer. You pay an excess which you can claim back.
