Returning from maternity leave question

So I'm currently on maternity leave and I was working full time before I went off. I had 18 days (135 hours) holiday that I wasn't able to take so it was agreed by my employer that this would be carried over and I could take it when I return from maternity leave. The plan is for me to return 3 days a week rather than the 5 I used to work. I used to do 37.5 over 5 days but I will be doing 25.5 over 3 (so an hour more than the typical day). My question is, because I am returning only part time, will this affect those holidays I am carrying over? I.e will I still get 135 hours or will that be changed in line with my part time hours? I really hope that makes sense, I don't know if I'm explaining what I mean very well!Manager is currently on annual leave so hoping someone can advise in the meantime.

Those 135hrs are from before your maternity so you are still owed the full amount. Do you have to pay back any maternity pay because you are dropping hours? I did and so used some of my owed holiday to ‘pay back’ what I owed.

Oh I'm really not sure about that? I should of mentioned I work for the NHS incase it's relevant. My manager never mentioned anything about having to pay maternity pay back.

As you're annual leave is from the last financial year and it was agreed to carry over I would have thought you'd be entitled to it all?
Of course going forward your annual leave will be pro rata.

Is your contract reducing to 3 days, or are you using your accrued hols to drop it down for a period (i.e. taking 2 days of hols a week?)

Assuming the former, the existing holiday will remain as is because it has already accrued, and then you accrue new hols pro rata on your new working pattern.

I've never heard of anyone needing to pay back mat pay when dropping to pt, only if you don't come back / leave after too short a period. That's interesting if that's happening in some places.

The 18 days are all already accrued. You don't lose those and offset them in full against your new hours.

Normally you agree part time to start when you physically go back to work so you take all the accrued A/L including the A/L whilst you were on maternity leave before you start back.

Maternity-A/L used up-start back to work part time

Then the A\L will be pro data from then on.

It will be in my contract to return 3 days. The HR aren't helpful in the slightest at my trust unfortunately. Does anyone know if I will have accrued all the bank holidays so the Christmas ones last what and the Easter/May ones? (I'm not returning until July). So that would be an extra 7 days? (I went off in October) I'm just a bit confused with it all!

Yes you accrue leave while you are off, including bank holidays. In the NHS you just need to return l, regardless of full time or part time and you will not be required to pay back enhance maternity pay. If you do not return at all then you would have to. So when your maternity leave finishes, you will have the annual leave carried over plus any accrued while you were off. You could use this in a block to extend your leave, or use this for a few weeks so that you return full time and work part time until your leave is used up. Then you change to part time. It depends what you have agreed with your line manager.
