Can anyone advise re tree removal?

Our neighbours have a large mature oak tree in their garden but very near our boundary. The tree has a TPO but they have applied for, and been granted, permission to fell on the advice of their insurance company, who have said that the tree is exacerbating some issues they are having with subsidence.

Does anyone know, if the removal of the tree (it's big!) causes any damage to our garden, or if there are subsequent problems with ground heave or flooding, have we got any redress through the council or our neighbours insurers?

Our insurers are not interested, they've said we are only insured against specific events and this isn't one of them. Our house is relatively new and the tree is at least 200 years old. The soil is clay and very boggy in the winter. I'm really worried about the effect of taking out the tree (as well as very sad that it's coming down, it's beautiful).

We did object to the fell application if that makes any difference.

There's some stuff online about risks on tree removal but I think it depends on how far away. May be speak to the council Tree Officer or a landscaper for advice. I can't see how your neighbour would be liable for any impact of their tree no longer drinking in your garden - presumably the opposite- if the tree is causing them subsidance issues it could cause you the same problem.
