Company won’t collect their property. What do I do?

A large flooring company who shall remain nameless delivered 58 boxes of LVT to and it turns out it was the incorrect type. Anyhow, after to-ing and fro-ing for about a month they agreed to refund £2800 and collect. We got the refund and awaited collection. This was 7 months ago!!!

We’ve called, emailed and even visited the store. No-one has been. It’s taking up a large portion of our garage. The only thing we can think of is to get a solicitor to write to them basically saying that if they don’t collect within 30 days then we consider the flooring to belong to us and then we sell it.

We’re at our wits end as we want to turn the garage into an office and this is stopping us doing that. Has anyone had something similar?

Tell them you’re moving outside and the elements will ruin it if the don’t collect by x time and date.

What do they say when you speak to them on the phone/Instore? What do the email replies say?

  1. write and say after 28 days from date of letter you will be charging storage.
  2. if nothing happens send an invoice to their head office.
  3. if nothing still happens, go to the small claims court and get a court order for the money (a court order, even for a small amount can play havoc with a company's credit ratings - most finance directors will get seriously pissed (& active) if one comes around)

7 months! I had it once with a well known supermarket and a faulty dishwasher for a week and i lost my sh1t with them. Brand new dishwasher delivered and connected up (paid extra). Dishwasher was faulty so rang for them to collect and exchange. They agreed to free connection for 2nd machine only when it arrived the chap wouldn't install it as the faulty one was still in situ and he refused to disconnect it. So he dumped the new machine in the hall and left the faulty one behind. When DH came home he swapped them over himself and put the faulty one in the hall. A week of chasing them to collect the faulty one got nowhere until I told them it was going out in the garden as it was in the way in the hall. They said I couldn't do that as it could get damaged and I'd be responsible. I pointed out that it a) didn't work anyway and b) was likely to get damaged as we squeezed past it with DDs wheelchair. I put it outside - they collected it the next day!
I'm not sure of your legal position OP but I think I'd be giving them official notice by recorded delivery.

Every time we call etc we get the same sorts of replies. Basically, they need to sort it out with an area manager/operations manager/complaints manager. We’ve heard it all. Once they even said they were coming and we had it all ready to go but no-one came. We contact them at least fortnightly either by phone or email and have loads of evidence to back up that we’ve contacted them. Whenever the managers respond they basically apologise for the delay and pass the buck onto someone else!

Tell them 7 days and it's going to the tip. As it's blocking an exit in the garage.
Then sell it haha

Send them an invoice for storage costs. They'll soon pick it up then.

Call them again and ask them if they agree to you disposing of it. Bet they do. They obviously don't want the hassle of collecting it.

Then sell it and keep the proceeds to compensate you for the hassle.

If they say no - ask them for a solution. If you are not satisfied with the solution or it doesnt materialise within a decent timeframe (say 4 weeks) then go to the small claims court.

If you twitter them they'd probably sort it in a few days. I've lost it with a few companies and got stuff sorted etc

I would definitely tweet them and state how long its been going on and ask when they are going to resolve it. I find it usually gets a quick response once its in the public domain.

id just sent a signed for letter that they have 60 days with picture proof of the letters wording, then another 3 weeks later with a 30 day notice with a end date and tell them if not collected by the end then you will be disposing of the flooring

if you do get rid of it i would reach out to a baby bank for example and ask if they know of anyone in need of some flooring as so many people out there in need of flooring

send them an official letter and tell them if they haven't arranged collection by x date you will start charging them storage costs of X amount per week.

That way you can back it up into small claims court once the costs start racking up ;)
