Help me work out how to leave

My husband just filed for divorce.
I'm disabled, I work part time. I have an income of around £900 per month

I'm on the mortgage for our house but don't contribute

How the living fuck do I move out on £900 a month?

Can anyone tell me what the rules are wrt housing benefit if you own a property ?

Have you spoken with citizens advice? They might have some good advice for you. I am sure lots of posters here will too but it is dinner time so it may take a while for them to come back to you.

We’re tou expecting this or, is it completely out of the blue?

I have seen the website entitled to mentione before. That can help you calculate any benefits you might be able to apply for.

You don't move out of the house. If it is owned in joint names you should get half if it is sold. See a solicitor and make sure you have details of your accounts et etc. Would your share let you buy a smaller property or buy a shared ownership property?

You should be entitled to some of the property, pension etc. Gather as much financial info as you can, go see citizens advice, see a solicitor, do not move out for now. Do not tell him anything you’re doing.

Do you get PIP?

If you're eligible for means-tested benefits, you would claim Universal Credit, not Housing Benefit (working age people can't make new claims for HB and must claim UC instead).

If you're separating and move out of a jointly owned property, it's disregarded for 6 months, so you will be able to claim UC during that time to help with your rent costs, but meanwhile you'll need to sort out a financial settlement.

Do you know how much the house is worth and how much of the mortgage is outstanding? Do you and your husband have any other significant assets such as other property, pensions, savings etc?

It would be a good idea to get together information about the marital assets and then get some legal advice. Your local Citizens Advice should be able to signpost you to local law clinics and solicitors offering a free or low cost initial consultation.

This website is really helpful too

Hi OP what a tricky situation.

If I were you I'd get a fucking bulldog solicitor on my side!

Don't move out. Starting point is you're entitled to half. Why should you leave the house? Nope.

I'd go to citizens advise and make sure you're getting every benefit you're entitled to. Bearing in mind this is likely to change when you no longer live in the same house as DH.

Thirdly. Are you able to increase your income? Appreciate This might not be possible for various reasons.
