Husband has told me he’s taking me off insurance on his car - is there anything I can do?

We’ve separated

He’s registered as the keeper although it’s a joint asset - it’s worth more than mine which he took when he moved out (I think he’s had a change of heart as my little banger doesn’t do his image any good Hmm )

I need this car to accommodate all my kids - the other car he’s driving was a run around and is too small- it also needed essential works doing to it which he’s not done and his sister has informed me he’s been doing 1000’s of miles on it since he drove off in it

I’ve rung my insurance and they’ve said If the car has a policy on it already (and he’s taken me off as a named driver) there’s nothing I can do

I’m going to be very stuck without a car in the summer holidays stuck in the middle of nowhere - and I don’t want to drive uninsured

any ideas?

What do you mean by too small?

Physically impossible to get you all in, or just slightly annoying?

Ops husband is driving ops car. Its on its last legs, would cost a fortune in repairs and won't accommodate all her children.
The car she's driving at the moment is her husbands car. For practical reasons, she wants to hang onto that.
She doesn't want her car back and she doesn't want to swap cars. He already holds the insurance on both cars and you don't have to be the owner of the car to take out insurance. He hasn't stolen anything, he's reneged on an understanding. She's not going to break the law to get the car back.

The current situation isn’t at all illegal, forging her husbands signature however to transfer the keeper is.

If you have insurance in your own name (I think you do, on the banger), you can drive any other car under third party insurance.
So if you have access to the car he wants, you can legally drive it under your own insurance.

She needs the owners permission or the insurance isn’t valid.

Totally depends on the policy. Its not standard.

She says the car she has is owned jointly but he is down as the registered keeper. He isn't the keeper, she is.

People seem to think being the registered keeper means you own the car, trying telling that to your boss if you are the registered keeper of a company car.

I dont understand why you cant insure it.

My DH car was written off many years ago and he was broke so I bought a little run around for us to use until everything was sorted.

My DH (back then boyfriend who didnt even live with me) was the only driver as I didnt have a license, he was not ever the owner of the car (everything ownership wise was my name as I bought the car and sold the car later) and insurance didnt care if he 'owned' it or not just that he was the 'main' driver.

She doesn't need his signature to change the name of the registered keeper. You can do it online.

My advice is :

Report your own car to the police as being stolen as you need that back.

Get yourself a good lawyer to deal with your divorce and sort out the maintenance issues(Citizens Advice can recommend a solicitor for you)

No, what is illegal is not declaring the correct keeper to the DVLA. Its fraud on behalf of both parties. You complete the transfer form and just sign your bit, leave the other bit unsigned.

The purpose of the V5 is who is responsible for the car - if you drive it, park it and its in your possession and has been for sometime, you are the keeper. It is not related to ownership.

Alas no advice on the car but just to say sorry your husband has turned into such a bellend. Reminds me of my dad... things did get better for my mum, hang on in there.

I was just coming on here to say this. If it was bough jointly, with joint money, then its a joint asset, the keeper is irrelevant.

In this instance though, first thing you need to do is remove him off the insurance for the car he is driving, and remove his permission to drive it... then report him as Driving Without Consent to the Police.

If you are insured on the other car you can drive via car on that insurance (usually) often only 3rd party but it is legal.

Take him off the insurance on the small car and use it as part exchange on a more suitable car? If you can't afford this do you have a family member that can lend you the money for the repairs and you can pay them back when the settlement is sorted?

No, that's not the case anymore. Most policies state clearly they do not cover 3rd party vehicles.

Do you know when your insurance policy runs out/renews?
A lot of car insurance companies charge you for ending insurance early.

Are you paying insurance for both of the cars?

I would go to CMS and get maintenance payments sorted and find out how much it would be to cancel the insurance.
You can ask him to swap cars but I doubt he will so instead of spending money on a small courts claim I would just save up for a new one using the maintenance money.
