I've just had a contract for part time work (I've only had full time before)
There's a clause that says
'I'm entitled to the pro rats equivalent of 22 days paid holiday plus pro rata of all normal public and bank holidays, I must use my holiday leave on bank holidays and public holiday days (as I work Mon and Friday, that will be a fair few) so I'm just wondering what I will actually get.

How many hours do you work and what are full time hours in your role?

mineofuselessinformation · 10/08/2021 19:39

8 public holidays, so total holiday days = 30.

Step 1:
Your hours divided by full time hours. (Leave the answer on the screen.)

Step 2:
X 30 =

That's your answer.

(Although I'm now wondering if the public holidays includes Easter Sunday? You'll need to check.)

@ChewChewPanda I will work 20hrs a week (spread over 4 days)
The company full time hours are I think 8-5.

OP posts:
Beachlover77 · 10/08/2021 20:05

@mineofuselessinformation
20/45 =0.44
0.44x30 =13.33
So I would get 13 days but then I need to use approx 8 of those for bank/public holidays which leave approx 5 days?? Have I done that right?

Your downfall here is going to be the fact you work on Monday and Fridays, as 5 of the BHs are always on a Monday or Friday, and the other 3 move around.

As stated above, you have 30 days x whatever proportion you work

So, for me, I work 0.6 of a week, so I get 0.6 of a day on a Bank holiday, so if I take a Bank holiday off, I'm only "allocated" 0.6 of a day's hours, so I have to use some of my AL hours to make up to the fact I take the full day off.
eg a day is 7.5 hours
but my BH allocation is 4.5 hours
so if Christmas Day is on one of my working days I have to put 3 hours of my AL towards it.

OTOH, if a BH falls on a non working day, I "gain" the 4.5 hours to add to my AL. So, with my contract, it makes a lot of sense to not work Mondays or Fridays.

dementedpixie · 10/08/2021 20:12

So you work 4 days out of 5 (is it the same number of hours each day?)

If full timers get 30 days in total then you get â…˜ of 30 days = 24 days (although your day will be shorter than a full timers day)

Take off any bank holidays that fall on a working day and what you're left with is to take as you choose

Tickledtrout · 10/08/2021 20:15

No the 8-5 will include some unpaid lunch. So maybe 40 hours is fte? Or maybe nobody works 8-5 every day and it's 37.5 ? You'll need to check

ChewChewPanda · 10/08/2021 20:16

Assuming that 8-5 includes an unpaid hour for lunch then full time hours are 40 so you’ll get half the holiday allowance and half the bank holidays paid. But would need to use holiday allowance to make up the other half of bank holidays where you were due to work.

Your work may track your holiday in hours rather than days given your working pattern (mine does) - if so I think you’d get 120 hours including bank holiday hours which would be 24 of your usual 5 hour days off. However you would need to use 5 hours for each bank holiday that falls on one of your working days, so up to 40 hours a year would be planned for you.

Beachlover77 · 10/08/2021 20:19

I'm even more confused now 😫
Yes I work same hours each day 5hrs

PeonyTime · 10/08/2021 20:20

If you work shorter days than others, you need to calculate leave in hours.

dementedpixie · 10/08/2021 20:23

So full timers get 30 days which is 6 weeks worth of holidays.

6weeks x 20 hours = 120 hours = 24 of your shorter days (if you do 5 hours a day)

Take off bank holiday hours and what's left is yours to choose

dementedpixie · 10/08/2021 20:24

24 of your shorter days then or 120 hours of holiday if they do it in hours

Beachlover77 · 10/08/2021 20:26

Either way, I'm thinking it's not much is it.

dementedpixie · 10/08/2021 20:28

24 days off isn't bad tbh
Your employer offers more than the statutory minimum which is 28 days/5.6 weeks

NinaBallerinaShoes · 10/08/2021 20:29

Don’t forget to are entitled to pro rata Bank Holiday leave?

dementedpixie · 10/08/2021 20:31

24-7 bank holidays still leaves you with 17 days of your choice

Beachlover77 · 10/08/2021 20:33

@dementedpixie I then take off the bank holidays which would leave approx 16 days. Ok, that's not too bad, when I first tired to work it out I came up with just 5 days 🙈
Thanks everyone for trying to get me to understand!

OP posts:
dementedpixie · 10/08/2021 20:34

What actual days do you work?

ChewChewPanda · 10/08/2021 20:36

24 days isn’t bad (it’s 6 weeks if you work 4 days a week). But the need to use lots of them for bank holidays does make it less flexible. If your non working day was a Monday this would work the other way for you - you’d not need to use much of your leave allowance for bank holidays and therefore could take more of it when you wish.

Beachlover77 · 10/08/2021 20:42

@dementedpixie
I would work every day except Thursday.

OP posts:
titchy · 10/08/2021 20:43

It sounds like you're exactly half time. As you only work on four days it's probably easier to work out leave in hours.

Assuming you're half time, you'll get 30 (total leave) x 7.5 (hours worked in a full timer's day) x 0.5 (because you're half time). So 112.5 hours a year. You work a 5 hour day, so if one of your working days falls on a BH you need to use 5 hours leave to cover it. Depending on what days Christmas and NY BHs fall your leave will vary slightly each year.

Let's say for arguments sake all 8 BHs this year fall on one of your working days - that will take up 8 x 5 hours of your leave - 40 hours. Leaving you with 112.5-40=72.5. As you work 5 hour days that means you'd get 72.5/5 = 14.5 days to take whenever you want.

Clear?

dementedpixie · 10/08/2021 20:47

That doesn't give the correct number of hours/days. Basically OP is entitled to 6 weeks worth of holidays which is 6x20 hours = 120 hours which is 24 of OPs 5 hour days

titchy · 10/08/2021 21:20

You're right - my calculation was based on 7.5 hours being the standard working day. If 8 hours a day is the standard then leave will be 120 hours, less (8 x 5 = 40) bank holidays leaving 80 hours or 16 days leave.
