May I seek some advice? We bought a used car from a car dealer online. After three weeks, there is a warning light on about the parking brake. We reported this to the dealer but he said the issue is purely because the car has not been in use for long time and the light would be off after we drive it for some more time.
The car dealer is located very far away. We have the car checked by local garage and confirmed that there is issue with the the parking brake actuator. The replacement cost is substantial.
According to the Consumer Rights Act, if the car is faulty in the initial 30 days, we have the right to reject it and get a refund, or ask for it to be repaired, so we asked the dealer to absorb the cost. But he rejected saying the invoice contained a T&C that dealer's liability is for major mechanical faults and the issue of parking brake actuator is not a mechanical fault.
I believe the Consumer Right Act is a law that all car dealers have to follow and they can't create their own T&C to "narrow down" their liabilities, so in my case, the car dealer have to take the responsibility. May I have your thoughts and advice please?
