Were the police at fault?

My dp was involved in an accident just before the Euros final . He was run over by a car and left in a serious condition . He was unresponsive on the scene but came round and is recovering now . He Had a lot of brain trauma and has been left with a serious ligaments injury where he is going to need an operation .
However , we have been told after enquiring about the driver that he wasn’t breathalysed at the scene of the accident as neither police car that attended had a breathalyser !!!

The officer who I was talking to me at the scene said the driver was being breathalysed in the other police car so why wasn’t he ? It was an hour and half before the match and the driver was obviously speeding as my dps injuries were too serious for the driving to have been doing 30mph .
Apparently the officer wasn’t sure what has gone on because he wasn’t dealing with the driver at the scene but his colleague told him the driver wasn’t showing any signs of having had a drink . He wasn’t red eyed , didn’t smell of alcohol and he wasn’t slurring his words !

Surely the police have failed my dp and should be made accountable for this ?

He was in an ambulance on the scene for over 40 mins and on the pavement being dealt with for nearly as long . Surely , a police car with a breathalyser could’ve been sent to the scene ?

Is this worthy of making a complaint to the police or do they only breathalyse at serious road accidents if they can smell alcohol ?

He still may be charged with other crimes, but there was probably a good enough reason to breathlyse him there or at the station if he was arrested.

Raise it, but don't expect an answer or reasonable explanation out of it; the outcome will sadly not make your partner get better quicker.

I thought this from The Independent was the case
Since 1992 all drivers in Britain are automatically breathalysed after accidents in which someone is injured. However, when no one is hurt it is up to the police officer's discretion whether drivers should be tested.
Has anyone instructed a solicitor?

The other driver should have been breathalysed and if the officers at the scene didn’t have one they should have requested another officer to bring one to them or taken the driver to a police station where they did have one. I think you should make a complaint

My dp is going to a solicitor next week . He only came out of hospital late last night .
His Sister had to chase the police to find out what was happening after they haven’t contacted us at all yet she’s had really odd call from someone claiming to be a police officer asking about his injuries yet they knew information about cctv which only the police know and yet the police officer she spoke to said he’s done some checks and no officer has contacted her from their records ! It’s all really weird .

That’s does sound odd and my cynical mind is wondering if the other driver was the officers mate or colleague?

I thought this aswell because it was really odd . The police officer speaking to me seemed very inexperienced . I even had to call him over to show him where my dps trainer landed which was a distance from the car on the other side of the road . He took photos on his phone but only after I made a fuss . We weren’t spoken to really in an official sense really and once he had personal details he just told me he would be in touch and the other officer with the driver didn’t speak to me at all at the scene .

I feel like something isn’t adding up !

Definitely make an official complaint. Something smells fishy here. I wonder if the police who attended knew the driver and are trying to protect him/ her

About 7 years ago we had a car accident and the police said it was standard to breathalyse all the drivers, whether they were at fault or not, whether they could smell alcohol on them or not. But, unless there was a free car, I wouldn't expect another policeman to come to the scene just to deliver a breathalyser, they would have been busy elsewhere. In the event of none being available at the accident I would have expected the driver to have been taken to the police station and checked there given the severity of your dps injuries. (A simple fender bender to be sorted by insurance not worth taking to the station, a serious accident I'd expect it.)

Was the driver taken in for a breathalyser at the station? This is the evidential one, the roadside ones can't be used as evidence, the machines at the station can.

Hope you get it all sorted and your dp recovers soon.

The driver may have been under the influence of drugs, so no alcohol smell.

I wonder if the other driver was one of their own, another police officer and they're trying to protect him. If not, then they are royalty ballsing this up!

I was in an accident that wasn't my fault. Three police cars turned up all had breathalysers but not one car had any tubes that fit on them. The policeman just asked me to breathe in his direction. They should all have the necessary equipment.
