Just received speeding ticket - car was parked at home at time?

Just got a Notice of Intended Prosecution for last Wednesday evening at 7.20pmfor a location about 5 miles away that we probably have driven down at some point but I couldn't say exactly when.

Last Wednesday was the night before my sons birthday. My husband was out in central London. I was in the middle of putting my son to be ahead of trying to finish off his birthday cake.

So clearly this either didn't happen at all, or at least not at the date and time on the letter.

There's no number on the letter and just a form to say if it was you or someone else. But clearly it was actually noone?

Anyone been in this situation? How do I sort it out? There's no photo attached to the letter but they say they have photographic evidence...

You can request a copy of the photo.

Your plates could have been cloned.

VettiyaIruken · 07/05/2021 10:57

Ask for the photo

BirdsRoundandRound · 07/05/2021 10:59

Thanks - seems like that must have happened.

Any idea who/how to request the photo? There are no contact details of any kind on the letter

I’d be concerned it was a fake letter designed to get you to pay to some random scammer, myself. Seems very weird they’re giving you no contact information!
What’s on the letterhead?

BirdsRoundandRound · 07/05/2021 11:01

Ah just found out I can log in online and view - it's not our bloody car Angry

It's met police. But there's no option to say that this isn't our car!!

It's not even the same make as far as I can tell

If it’s your numberplate but not your car, then your plate has been cloned. I’d call the police on 101 and report it.

FAQs · 07/05/2021 11:07

Is there an appeal option?

Yes do this but also respond to the NIP with a paper trail and a picture of your car and the crime reference number from the police. Or you could end up with ccj where they think you’ve ignored them.
MrsFin · 07/05/2021 11:10

You can challenge. I did so they relooked at the photo and realised that the letter on the plate they thought was an E was actually a C with a badly placed screw in the middle of it.
The "real" car just happened to be a similar colour and make to mine!

Don't fill the form in, send it back with a letter explaining the situation seems the obvious thing to do, am I missing a complication?
Whythesadface · 07/05/2021 11:11

I'd also send a photo of your car.
Maybe call the non emergency number for your area and speak to someone.

Acovic · 07/05/2021 11:15

Don't send a photo of your car - send a screengrab or saved PDF of the bit on the DVLA website that tells you the make model and colour of your car - far more official.

I'm surprised the police don't check this tbh,

BarbaraofSeville · 07/05/2021 11:27

If you can view online, isn't there an option there to register the dispute?

Cloning is quite common. There's probably thousands of people committing multiple motoring offences knowing that other people will be sent NIPs for them.

Colleague was sent one accusing him of not paying the London congestion charge, despite us being based hundreds of miles away and him having never driven in London.

BirdsRoundandRound · 07/05/2021 11:28

They have got the numberplate wrong - it's a 7 instead of a 1 and a different make of car.

Can imagine this is going to be a right ballache to sort out

It should be fine. That must happen all the time. The photos are quite grainy, but it should be pretty easy to explain it's not your car.
BarbaraofSeville · 07/05/2021 11:30

If that's what it is, just put a note with the form telling them that.

Shouldn't be a faff at all, once a person looks at the photograph, they'll know they've got it wrong and send the NIP to the correct person and take no further action against you.

Wiaa · 07/05/2021 11:36

We have had this happen, we went into the local station and they told us Not to return the form but gave us the number of the department we needed to call. We then sent pics of our car and eventually received a letter informing us to mark our number plate in a certain way. No idea if it was linked but the car was stolen around a year later but found after a week and had been valeted and our stuff was left in a carrier bag in the boot

MrsRandallFraser · 07/05/2021 11:54

I've had similar, not for speeding but for stopping in a hatched box, was relatively easy to sort out. I appealed it and sent evidence that my car was x-model with x-registration plate, I think I took a picture of my car and sent a copy of the registered keeper form that had make, model and colour etc. It was relatively simple actually.

BirdsRoundandRound · 07/05/2021 12:58

Update: yes was v easy to sort, I called 101 and got put through to the right department, who checked the photo and agreed the mistake and cancelled the ticket.

So panic over!
