Holding deposit

Went through the whole process for renting paid a holding deposit the refrenceing company agent were using informed me i had a ccj(wasnt aware untill then). So i looked into it. After a lot of digging and phone calls i found out what it was for(catalouge) and i PAID what i owed the full debt plus some other fee but still i paid it. I then informed the agent and sent screenshot as records can take 4/6 weeks to update then the refrence company passed ALL the checks. A week later i got a call to say lanlord gets final say and didnt want to rent to me as i had Ccj . So am i entiled to my holding deposit back. Kind if feel like i was punished for a problem i fixed.

The holding deposit has to be returned if you fail a credit check, as long as you have been honest. Did they specifically ask you if you had any CCJs?

They will probably argue that it is your fault for not checking your credit record and knowing that you had an outstanding debt. You should have known that you hadn't paid off the catalogue at the time. Sorry. It's your mistake for not knowing about the CCJ so why should the landlord be penalised for your mistake? If you had known and told the landlord, they wouldn't have gone ahead with the credit checks (which cost money) and they wouldn't have taken the property off the market, delaying finding a tenant, which is costing the landlord money.

It's more your fault than the landlord's fault. You have my sympathy though. You can check your credit reports for free to prevent this happening again in the future:

Sorry that this been an expensive mistake for you. There is no harm in asking them to return the holding deposit - you could try arguing that you answered honestly and offer to pay for the credit check costs.
