Universal credit and owning a house that the ex lives in

Does anyone know if it's possible to claim universal credit if you've moved out of a house that you own with your ex which your child still lives in? Some equity but not a lot and no plan to sell the house?

I believe the 'entitled to' calculator words it is as 'Are you living as a couple in the same house?'

The answer will be no as you're not part of a couple- and living separately. Therefore you will each have to claim separately.

Are you paying rent where you live at the moment? I think it would depend on the equity - is he planning to buy you out of the property?

I think it would be classed as an asset. Call the Citizens Advice Help to Claim team and they will advise you properly: 0800 144 8 444

It's actually my brother and his ex partner. She earns more but works less so their DS will stay with her and he will move out. He will pay rent while she covers the mortgage. I guess she will buy him out but in the short term he can't live there or get the equity out

Thanks, the query is whether he can claim after he has moved out even though he owns this asset though he can't get any equity out of it

You would need to buy him out or vice versa they class it as an asset

To be honest unless his rent is pretty high and his wages very low he's unlikely to get any Uc as a single person with no kids living with him but it does depend on amounts. The equity in the house can be disregarded for a while if plans are being made for it to be sold but that doesn't sound like the case so I'm not sure what would happen. Best thing is just for him to declare the property on his Uc claim and see what happens. She will need to buy him out at some point and then if equity he receives is over 16k he would not be eligible for Uc unless he is putting that equity into another property in which case he wouldn't be paying rent anyway.

Thanks He is looking for work so should be entitled to help until he is working. This is just to get him out of the family home and living separately. That is what I wanted to know - if it will be disregarded for a while given he can't live there or sell it without her agreement and wouldn't want to anyway as it's their DS's home

Aah sorry I didn't realize he wasn't working . In that case yes he would definitely get some help. If private renting then Uc would only pay up to the local housing allowance for one bedroom in his area. If he is under 35 it would be shared accommodation rate. So he really needs to keep within the local housing allowance they will pay or he will end up having to pay extra rent himself. He also needs to be aware that the standard Uc element will be dropping by about £80 a month in september as the covid increase is ending then.
