Problem with eBay purchase

I bought a jacket from an online retailer that I really liked but it was expensive.

I saw the exact same one on eBay, same size, colour etc and barely worn. I bought it.

When it arrived I noticed the size tag wasn’t on it. When I compared it to the original one (hadn’t returned it yet), the eBay one is smaller and feels a bit tight. I’ve contacted the seller and he insists it is the size he says it is.

What would you do?

I'd open a case for not as described, and make sure I uploaded all the information to it.Do you still have the first one so you can do comparison measurements and photos?

Yes I do and I took pictures and emailed them to the seller showing the difference. He still says it’s the size it is and hasn’t answered my question as to why the size tag has been removed

Stop engaging with the seller just open a case. You'll get a refund.

The tag has been removed because the seller will have bought a job lot of label clothing from a wholesaler, one of the conditions of resale is that they have to deface or remove the clothing label.

It could be a seconds or mis-labelled in terms of size. Either way, opening a case should sort it.
You should also be able to return within 14 days under distance selling regs, and if there is a fault with the item I think they have to pay for the return shipping and give you a full refund. This should be an option if the seller is a business seller, without needing to open a case! A shame they haven't been more helpful thus far. Hope you get it sorted.
