Help! CCJ that I didn't know about

Just about to apply for a small loan in my name as I want to landscape the garden.
Thought I'd check my credit file first and it appears I have a CCJ for £197!

It was issued in my maiden name in 2018 about 6 months after I moved house.
As I'd moved I didn't receive any letters and hence had no idea.
I'm guessing it was a probably a parking fine as I can't think of anyone I owe money to and my driving licence is still in my maiden name.

I've applied for a next account and a mobile phone contract successfully since so genuinely had no idea anything was amiss.

From what I've read I can apply to have it 'set aside' by a judge but this costs £225

Does anyone have any experience of dealing with this?

If you think that you genuinely owe it, then you could pay it off and ask for a notice of satisfaction to show it has been paid. Your other option is to have it set aside. It will drop off your record after 6 years.

I'm happy to pay it but does a notice of satisfaction still flag up on your credit file?
We need to remortgage next year (joint house) and my husband is threatening to remove me as he thinks I'll scupper any good deals!

Yes it shows up but will state that it is satisfied. I would speak to a good broker about the mortgage.

“Set aside” means the cjp is effectively cancelled and removed. If you genuinely owe it then it is unlikely a judge would do this unless there were very valid reasons. Probably best to pay it off and get a note on your file.

I have similar. Paid it off and got a note added to explain that I had moved house 8 months before the CCJ date. Thankfully, no major impact on my mortgage application in terms of the interest rate, though it did hugely limit which brokers and banks would even work with me.

Is your husband also planning to pay you for your share of the house, considering he's thing of removing you from the mortgage?! I don't think it can be done without your consent, anyway 🤔

Call the company you owe the money to (you can source this via the CCJ information) and offer to pay the debt in full providing a consent order is issued to set aside the CCJ. This effectively removed the CCJ altogether and the company get paid. If you just leave it satisfied, you will still struggle for certain lines of credit as the CCJ will show for 6 years regardless if it is marked satisfied or not.

Yes I'm thinking that really I should apply to get it 'set aside' rather than satisfied. I think I have good grounds as I can prove that I had moved house and had taken reasonable steps to update my details with the DVLA etc. If a judge agrees then it is removed from my file but puts me back to square one with regard to paying the debt. I'm happy to just pay it at that point.

Thank you. I haven't heard of a consent order so will look into that.
