Should I cash this cheque?

Before I start, Daily Mail are trash.

Quick summary -

May 2018 - I lived in a house share and dealt with all of the bills for the house. I switched to a new energy supplier and set up the account in my name
June 2018 - I decide to move out of the house and call the energy supplier to tell them and to close the account. They say that because the account has been open only a couple of weeks and we haven’t had a bill yet, they can’t close the account but will instead add the person taking over the bills to the account.
April 2020 - the guy taking over the bills for the house (A) moves out and despite paying by direct debit each month there is a £500 debt on the account
January 2021 - I start getting letters from a debt collection agency for this £500 as apparently my name was still the main contact on the account and A hasn’t paid his debt. I contact A to pay the debt and he acknowledges my email but doesn’t pay and I don’t hear from him again.
February 2021 - I prove to the energy supplier the date I moved out and they agree to close my account backdated to June 2018.

Now this is where it becomes odd. From June 2018 to April 2020 when the account was closed by A, approximately £2.5k was paid in. The energy company are now saying that because they have closed the account from the date I moved out, they cannot keep this £2.5k so have sent it to me by cheque. And in doing so, apparently they have opened A his own account and set the balance at -£3k to cover this £2.5k plus the original £500

I feel terrible that they have effectively taken money paid in by A and given it to me in the form of this cheque so what should I do with it? Do I cash it and transfer him the money and then let him deal with the extra £500? Or what if I transfer him the money and he uses it for something else? But then I guess it’s not my problem what he does with it but at least my conscience is clean

Can you not get them to write the cheque to him instead, if you instruct them in writing? If not then cash it and make a bank transfer to him. If he doesn't settle his bill with it it's his problem.

It’s a bit of a non issue. You cash it. And email him asking for either his bank account details of his new energy account details and pop it back on that new account.

Yes I asked them to instead just transfer the balance to his account but they were adamant that the only option was to send me this cheque.

I guess he’ll still owe the money regardless so the only option is to cash the cheque and transfer it to him for him to do what he pleases with it.

Obviously I have no intention of keeping the money but I’m slightly cheesed off he was happy for me to be chased by the debt collectors for his £500 which he knew he owed for almost a year.

For God's sake don't do this Hmm This is totally not a non-issue and if you cash that cheque you're putting yourself at serious risk.

As soon as the energy company realise their error they'll re-credit the £2500 to the bloke's account. There will be no need for him to pay them anything...he can easily prove his past payments, they'll realise and will refund the £2500 debit to his account.

They're not going to write it off though if you've received £2500 you're not entitled to, they're going to chase you for it.

When it all comes to light and they send you a bill for the £2500 they paid you in error and you don't have it because you've bank transferred it to him - that will be YOUR bad luck. You'll still owe the energy company the £2500 they paid you in error.

You know its a cock up. Rip the cheque up and call them to correct it. That's it, no need to be cashing any cheque or paying anyone anything.

Can you endorse the chq over to him & give it to him? If u do keep a cooy of chq & endorsement...

Def do not lodge it to your account for any reason..

FredaFlinstone is right. I'd contact them again and ask for it in writing why they've sent you the money and confirming you don't owe a balance as of this date at the very least before I'd do anything.

Write to the energy company with the details from your OP and send the cheque back.
Don't cash it.
They have issued it to you in error.
Let them deal with him direct.

I wouldn’t cash it and send him the money. He won’t pay it to them and when they realise how they’ve fucked up they’ll reclaim it from you.

I would return the cheque via recorded delivery with a detailed letter explaining everything and hopefully someone with some sense will read it. I’d also get it in writing that your account is closed and your balance is £0.

Oh some very different views. The original conversation was through the complaints team and the online portal is now giving me the option to escalate it so perhaps if I do that I’ll be able to speak to someone more senior.

It just seems so bizarre that they’ve sent me a cheque for £2.5k which they know wasn’t paid to them by me, I just happened to be the account holder.

I do hope you haven’t cashed it. Its not your money, and this is an especially horrendous time to suddenly be asked for £3k.

I would be very wary of cashing and transferring privately and would push for the energy supplier to resolve.

They will very soon have the guy who paid the money on complaining about his missing money

But seriously, best thing to do is let the company know so they can cancel the cheque and credit A with the £2,500

You don’t want to be chased afterwards to pay back money that wasn’t yours in the first place so it’s best to get the cheque canceled and do not cash it.

If its a crossed cheque (and it likely is) then you can't do that.

I'd keep a hold of it and not pay it in or send it anywhere until you've spoken to the company and escalated it with them
