A quick legal question

Good morning
Ds was relating a tale to me last night about his mate. For this story, I shall call him Dave

Dave (16) has bought himself a bb gun.
He has not told his parents. He lives with his parents and siblings. Dave is eldest child.
Dave and ds often hang out together. They have spent the last few days shooting empty cola cans in my back garden.
All harmless so far.
No shortage of cans and no danger to anybody.
Dave is very attached to his gun and starts taking it everywhere he goes.
Being 16 and a bit of a show off , he takes his gun out and shoots the floor when he is near people he knows. Makes a noise and laughs . Then rides away on his bike. Silly. I know.
He pulls this silly stunt in town near some of his class mates. One (girl) assumed dave was shooting at her. And called the police.
The police catch up with dave and take the gun and his phone off him.
Dave's parents are informed by the police as to what has happened. They will obviously deal with dave in whatever manner they decide.
But what happens to his phone? And gun? And ammo?
I believe here, you can buy/own a bb gun at 14.

No idea but I'm assuming you are just more than Dave's friends mum or you wouldnt care this much. Depending on what country you are in Dave is lucky the police didn't shoot him!

No idea about the phone but surely if you're going around harassing people with a BB gun the police aren't gonna return it to you.

I know dave has been an idiot!
My concern is my ds. Who was nothing to do with this incident.

Apparently the the police have told dave he cant see my ds for 10 weeks.
Ds was not in town when dave had this incident. Ds has not been anywhere other than our garden in weeks!
(Ok; ds is cheeky and wanted to carry on shooting cans.... and texting his mate)

I come from an estate where lots of young lads carried BB guns and its really not the shits and giggles you make out. They're seriously intimidating and can do serious damage and even kill. Can you imagine what it feels like to an vulnerable elderly person seeing that in their community, or how a young girl might feel rejecting the advances of someone who they know has a gun in their rucksack. Its about power and intimidation and you sound dim as fuck for trying to be cool mom.

When I was 16, a friend who was 17 was permanently paralysed after being shot in the spine by a BB gun. They are so, so dangerous, and really shouldn't be allowed freely.

They are so incredibly dangerous.

As a teen one of my friends was blinded in one eye because him and his idiot friends were shooting targets with a BB gun and one of the bbs ricocheted and hit him.

They should not be legal.

Think Dave is lucky he lives here because I've heard of quite a few fatal shootings where a teen as a Bb or imitation gun and has been killed. I'd be encouraging my son to have better friends personally.

  1. Even though it's not a "real" gun that doesn't mean it's not dangerous. It can be used to intimidate, bully and harass people. I personally don't see the reason to have one other than to make yourself seem big and intimidating.
  1. (Possibly triggering) Literally dats ago a friend posted an incident that happened to her SIL and BIL. From what I can tell there was a long standing dispute between neighbours, the SIL and BIL were shovelling snow, have argument with neighbour who pulls out a gun and shoots both of them multiple times, goes back into house, gets another gun (shot gun I think) and comes back and finishes them off, then goes back to short himself. Senseless killing and three lives lost in a moment of rage.while a BB gun can't cause the same devastation, it is easy to go and grab in a moment of rage. The incident really shook me.

So good on the police. I think his phone being taken away is appropriate too, they need to check 1. How he got the weapon and 2. If he is involved in any groups or anything that makes him dangerous.

It may be an over reaction it may not be. I know people who had them when they were younger and they are very normal (or as normal as people are), but I really see no difference between using a gun, bb or not, I'm public and carrying a knife.

If I was you, I'd be telling my DS hes been a fucking idiot going anywhere near Dave and no Dave wont be coming anywhere near my house. You are judged by the behaviour of the people you choose to spend time with. Dave will drag your DS down

If he wants to shoot guns safely he should join Army cadets. Guns should only ever be shot in a shooting range with a trained professional.

What on earth were you thinking letting them shoit BB guns in the garden? I think you need to reassess your own values

The law - if he is only 16 he is not allowed to have it outside the garden without adult supervision. Depending on whether it is classed as a "realistic imitation firearm" (basically, is it completely black?) then he is either in deep shit or a whole world of shit.

If it is you who has bought the gun for your son and Dave then you are also in a whole world of shit because it is an offence to fail to take reasonable precautions to stop a person under 18 from gaining unauthorised access to it.

It is an offence for Dave to have it in town (or anywhere other than private premises with the consent of the occupier)

It is an offence to have a realistic imitation firearm (if it is all black).

It's an offence for whoever sold it to him to do so because he is under 18 (if it was sold directly to him and not to an adult).

And definitely an offence for him to be waving it around and making other people scared enough to call the police.

What will happen to his phone - the police will go through it. To the gun and ammo - probably forfeiture and destruction, at the sentencing stage.

Just to clarify
I figured if they wanted to shoot, my enclosed garden was a safe place.
No, I did not buy the gun. Or any of the bits that go with it.
Its bright orange! So I don't think it is an imitation one.
I know dave is an idiot. But i didnt realise they were quite that dangerous!
Ds had a debit card at 11.
Never much money on it, but he had one.
Ds did not buy the gun. I have no idea where dave got it from.
I really was hoping being allowed to shoot in the garden would keep him off the streets!

With lockdown kids shouldn't be on the streets anyway. Anyone who is visiting someone not in their own bubble needs their values looked at/is a bit of an idiot. Idiots shouldn't be encouraged to hang out with your child.

Of course he won't get the gun/ammo back!

Knives are not illegal, but the police won't give you a knife back either if you were picked up after threatening people with it.

Dave sounds bloody dangerous and I think you should be grateful for an excuse to get your ds to distance from him.
