Eviction in 11 days?!

Had a letter through to say landlord has put in for eviction and evictions were only protected until 11th January. Nothing I can find online seems to point to this having changed despite tier changes.

I’m out of work due to the pandemic, only receive 200ppm with UC. How can they kick me out in 11 days? Will they? I’ve been applying to jobs for months but nothing!

Assuming you are in England, you do not need to leave until there is a bailiffs warrant ordered by the court.

Have you had a valid notice, that has expired? The rules on notices and evictions have changed , a lot, during Covid.

Please contact your local authority housing team for advice on Monday.

I’m 3 months behind. They put in for the eviction during the first lockdown I think when my ex partner also lived here but he’s gone now.

OP - This isn't really the place to ask . Not many people know anything about housing law .

When was the notice served? How long did it give? When did it expire? Was it served on form 6a? Did you receive deposit protection details, EPC, gas safety cert, how to rent booklet from your landlord? Is this the first court application? Are you in rent arrears?

Shouldn’t you get housing benefit? If you’ve not paid anything and he has a mortgage it could be a dicey situation all round.

Is this a notice of intended eviction, as in your landlord intents to apply to the court for your eviction on the 11th of January? Or is in a notice of eviction (as in you will be evicted from the property) on the 11th of January?

If it’s the former it’s my understanding that you get 6-8 weeks from the date the eviction has been granted by the court to relocate or arrange emergency accommodation. If it’s the latter than yes, the eviction will go forward on that date.

In either case I would show your eviction notice to your local council/shelter. Lots of councils no longer arrange emergency accommodation or alternative accommodation until an eviction has actually taken place. That being said, it is still wise to talk to them and get all the information you can and be as prepared as you can to leave on the date of eviction, so box up anything you don’t need out, box or store any valuables/treasured items in a safe place and have empty boxes ready to put all your essential items in for when it’s time to leave. This will be awful to do, but will be much less stressful in the long run as you’ll be prepared, organised and ready. Oh and label everything you can so you can find it easily later.

On the UC that seems low. Have a look at your UC statement to see if you think it is correct. Contact citizens advice or another welfare charity if you want to get more information.

Some eviction rules are changing on 11 Jan but they absolutely do not mean that you have to leave immediately.

In England would need to serve proper notice and a court order and formal eviction

The letter you got today might be a follow up from the original eviction notice you say you got during the first lockdown. With Covid, evictions required a 6 month notice unless you are more than six months in rent arrears. So, it might be that you’ve had more than 6 months notice and the 11 Jan date letter is a reminder notice.

But don’t know without seeing everything you’ve been sent. So take all your paperwork and go get professional advice.

With covid it's 6 months' notice only if it was signed on or after 29th August

Yep for England. I think it is 24 July for Wales.
Question is whether the first eviction notice she mentions happening “during lockdown” was done between 26 March-28 August, in which case it only need be a 3 month notice.
Not sure if say for example the first lockdown eviction notice were done on 11 June and then the 29 August law change meant the original 3 months ending 11 October would then be automatically extended to 6 months so now ending on 11 Jan?
I’m not an expert! So OP definitely needs to gather all the notices she has received and get expert advice.

Are they actually telling you to leave by the 11th or just saying they will take action then? I mean it doesn't really matter anyway, as PP said you need to wait for bailiffs to turn up.

What section is on the notice? Is it a section 21?

Do not leave the property until you are removed by bailiffs - the court and bailiff process could buy you an additional six months, if you leave before a court order and bailiffs some councils will say you have made yourself intentionally homeless.

Your UC amount is very low, do you claim the housing element?

You need to speak to Shelter and your local authority but do not leave the property.

Bailiffs are not currently working unless you are in a tier 1
