Alley way ownership

Really boring problem
My house and next doors house has a covered alley way between us
The light fixed to their wall hasn't been working for quite a few months and now it's getting dark earlier and as I work late it's getting pretty dark
I reported it to my local council but they got back to me and said they don't own the land and told me to contact land registry
I looked and no where can I see anything about alleys, only properties and paying to see this.
I'm housing association and my next door neighbour is council.
I've recently started a new job that finishes in the early hours, all street lights, garage lights are off from midnight
Does anyone know how I can find out who actually owns this?

Well somebody must be paying for the electricity to light the thing (when it's working obviously) so whoever that is would be responsible for it.

Did you contact the highways department? They do street lighting.

Ffsnosexallowed · 27/11/2020 21:42

Even if your neighbour does own it its unlikely that they have a responsibility to maintain it for you. Get your own outside light?

Dinky2004 · 27/11/2020 21:45

Thanks, I've only "contacted my local council as they provide all street lights but as they said they don't do alley lights
They directed me to land registry but I'm coming up to a blank there as well

Get a good torch is probably as good.

Dinky2004 · 27/11/2020 21:58

it's a flying freehold, hence why you need to contact the land registry. If you are a tenant, it's up to the landlord, if you bought it your solicitor should have bought it up.

It says in the OP that one side is a council house and the other is housing association. So one of them must be responsible.
Dinky2004 · 27/11/2020 22:10

@02haircutsRus yes I've contacted the council and also my housing association and both say they don't own the alley land, keep being referred to land registry but no where on the site can I find how to find out who is responsible for the alley

Maybe ask your electricity company for a steer? (A bit straw-clutchy, admittedly)

Dinky2004 · 27/11/2020 22:19

@16FlibbertyGiblets tbh I will do that because I'm just fed up now

Can't hurt to ask. Good luck!

Mysteryon · 27/11/2020 22:26

I’d suggest downloading the titles for the properties on either side, it’s likely that it’s either owned by one of them, or jointly owned down the middle.

But it’s unlikely that the title will oblige anyone to maintain lighting.

Have you tried speaking to your neighbour?

CatherinedeBourgh · 27/11/2020 22:29

Wouldn’ it be easier to just pay someone to fix it? Doubt it would cosy much...

user1493494961 · 27/11/2020 22:32

You could always buy your own light.

Dinky2004 · 27/11/2020 22:37

@26Mysteryon yes I spoke to my neighbour just in case they had bought their house but they hadn't
I did actually look at someone coming to look at it but they said that it's private land so they couldn't do it
I just can't find out who owns it!!!

It must belong to one house or the other surely? Why would the council install a light in a privately owned alleyway? I live in a terraced house with mine and my neighbour's front doors opposite one another halfway down the alley - is that the setup you mean? Our alley is jointly owned, each owning up to the midline down the full length on the ground, with flying freehold for the bits that overhang (next door at the front, me at the back).

There's a security sensor light in the alley because I got my electrician to install it, it runs off my electricity and the switch for it is in my house. The light is installed in the alley ceiling outside both our front doors, where I own the overhanging bit so the wiring runs under the floorboards of my upstairs cupboard.

The house next door was empty when I bought mine so I just got on with getting it installed, my neighbour who's moved in since then probably has no idea who's responsible for the light now that I think about it!

The wiring for this light must go somewhere, can you follow the wiring? If it's invisible when you look at the light fitting then the likelihood is that it goes in through the wall behind, so if it's on the wall of their house then the best guess is that it's running off their electricity supply and therefore their light?

As pp's have said though, it's pretty unlikely the deeds state that anyone is required to maintain a functioning light, so even if it is your neighbour's, if they're not bothered then you can't force them or their landlord to fix it.

MinnieMountain · 28/11/2020 06:23

The easiest thing is probably to ask your HA if you can get a light installed on your alley wall. Then you’ll be in control.

Itllbeaninterestingchristmas · 28/11/2020 06:42

I have a shared alleyway, owned half and half down the middle. The deeds state both side are responsible for maintenance but there’s no mention of lights. We have one each at opposite ends

Sunflowergirl1 · 28/11/2020 06:52

Download the deeds from the Land Registry for your property and next door. The owners of either house or just one will have responsibility...but they virtually never extends to lighting.

Frankly just put your own light up. You can even get LED ones that run on battery.

netstaller · 28/11/2020 08:31

Just get a light and stick it up

yeOldeTrout · 28/11/2020 16:42

I've had impression that if a person gets to day 10 without bad symptoms then it will never get terrible. They are on a path to recovery.

yeOldeTrout · 28/11/2020 16:52

oops, that's weird, posted to wrong thread!! Soz.
