DBS please help

Hi all

I have applied for a new job recently and it is something slightly different career path to what I have been doing before and seems to be a lot of compliance’s and checks (including a DBS) before I can start.

A few years ago (maybe 6/7 years ago) I was in the wrong place at the wrong time and ended up getting arrested and having to stay overnight at the station and having my fingerprints taken and mouth swabs, photos ETC and there was suppose to be a court trial however the situation was rectified and found to be a mistake and so my case was dropped / dismissed shortly after.

My worry now is would this be on my DBS and would it affect me getting this new job?

It depends on the reason for the arrest and the reason the check is needed. But don't panic as long as you can explain what happened, why and the outcome and it's not too serious most employers will be willing to continue considering your application. Certain convictions will prevent you from working in certain fields automatically but I'm sure you're aware of that. Did you get anything official from the police at the time regarding the outcome?

It won't show as there was no conviction.

Theoretically the police can add a note when there isn't a conviction but they rarely do.

I think the general answer is that on a basic check, no, but on an enhanced check, yes, possibly. But it's all about context and relevance. I have a conviction from 10+ years ago. It wasn't in the UK (I was living somewhere else at the time), but I have to declare it constantly, including on my visa and citizenship applications, because technically it could come up if there was a search in my home country. The conviction was equivalent to like 'causing a public nuisance' or something, so minor but technically a criminal offence. I ran a stop sign on my push bike. Got pulled over by the police (yes, really). In the place I was living there are technically no laws related to traffic violations on a push bike, so I had to go to court (couldn't just pay the fine). Literally, the entire court room was filled with other people who had been stopped for running traffic lights or stop signs on their bikes! I plead guilty (advised by court appointed solicitor), paid a fine, now have that charge on my record somewhere technically. I disclose it everywhere it might be possible for it to come up. Literally, no one has ever asked me about it and it's never stopped me getting a job or a visa or anything.

It very much depends on the crime, and the job you are applying for, and the approach taken by the employer. For example, a fraudulent crime may not be a concern in a job where you don't come into contact with other people's money, or GBH/ABH may not be a concern in a job where you aren't in contact with vulnerable people (I know of someone who has one of these on his record from about 30 years ago, but who has just been approved to foster).

You may want to contact Unlocked who may be able to advise you on whether this would show up. And others have said it may depend on a number of factors.

I've been arrested a few times but never charged (the price of being black in the UK) and fortunately it didn't come on my enhanced crb/dbs. I've been told it might come up on SC if I ever work for MOD etc but I haven't tested that yet or know how true that is.

All seems to be ok now and the process seems to be moving quicker now so hopefully it should be cleared by the weekend I’m hoping.
