Which car is at fault? (with diagram)

No actual contact made so just hypothetical-

Car A pulling out of side road, directly opposite the junction is a construction van parked with hazards on.
As Car A pulls out, Car B pulls out to go around the parked van.

If we had hit, who would be at fault?
Car A was pulling onto the main road, Car B was on the wrong side of the road.

Which car is at fault? (with diagram)

I don't think it's pointless, a genuine question with a diagram, so people get the full image rather than having to jump to conclusions.

Car A for me. Not based on fact though, just a strong hunch that you shouldn't pull out minor to major road unless it's safe to do so.

Car A is at fault, you should have checked left again before pulling out as there was clearly an obstruction already there and you should have anticipated someone may overtake.

I would've said car A because they should wait until the road is clear before entering the main road

I'd say car A as they were obviously at giveway point and car B was already on that road.

In law, him being on other side of the road means nothing as its legal.

There is no doubt, it is car B. Car A is emerging from a minor road into a major road.

If carB was already overtaking the van then Car A should wait until The way is clear to pull out of junction and turn left. But if Car A had already turned left out of the junction Car B should've waited until Car A had gone past.

It does seem unfair OP! I wouldn't worry about it, these things happen, and from what you've said there really isn't anything that could be done.

You mustn’t turn onto a road until it is clear. It doesn’t matter if the other car is pulling out dangerously.
